Gud Day Atty.,

I just want to ask, is it legal for the employer to issue a memo stating that "there will be a grace period of 45 days for turn-over / training starting the date of filling resignation letter" and is it just to say that "all those who will not comply with the 45 days grace period are subject to legal action". Most of the employees are resigning because of the working environment and the fact that they are charging guest with service charge but the company does not give it to the employees.

imo, the maximum should only be 30 days as per the labor code
