Excess Withholding Tax

Hello and God Bless.
Ask ko lang po what should i do with regards to withholding tax for 2011. Nahire po ako last Nov. 2010 dito sa current employer ko na nasa Ortigas. Nung nirelease nila ung ITR for 2011, ive found out na mali ang declaration nila sa aking Tax Status. Since 2008 po kasi dapat Married w/ 1 dependent na status ko pero ung current employer ko use the tax exemption for Married without dependent.

Ano po pde ko gawin para marefund ung excess withholding tax ko for 2011. Sabi po kasi ng employer ko dina daw nila marerefund ung excess kasi close na book nila for 2011. Considering that they are the one who misdeclare my tax status, entitled po ba ako sa refund?

You can ask for a tax refund but if they dont do that, then ask for a tax credit.

Can you please enlighten me on the difference between tax refund and tax credit? And how can i file tax credit if my employer refuse to process tax refund?

Sa tax refund ibabalik sayo yung sobrang naibayad mo. Sa tax credit, ibabawas yung naibayad mo sa babayaran mong tax.

How can I claim for a tax refund? And for a tax credit?

And in my situation, am i eligible to a refund or credit kasi my employer advised that they will not process refund or credit since i failed to provide them a copy of Form 2305 prior ending year 2011. I told them that i did not submitted this form to them since i was under the impression that my tax status from the previous RDO were already M1 and besides there was no changes on my status for 2011
