gandang araw po..

question lang po.

meron po kasi akong isang tao na pinautang. ang kolateral na binigay nya sa akin ay ATM payroll nya. tapos, me index card din po ako pinapirmahan sa kanya, acknowledgement of debt.. kasamahan po siya sa trabaho ng hipag ko. Ang nangyari po, ilang araw pagkakuha nya ng pera, bigla po cya nagresign sa trabaho. sa madaling sabi, ni isang hulog, wala ako nakuha sa kanya.

nagpunta po ako sa baranggay para iblotter report. halata pong nagtatago kasi sinasabi na di daw dun nakatira. samantalang sabi ng kagawad, nakita pa daw ung mag-ama nung nangutang nung umaga.

ano po ba ang puede kong gawin? gusto ko po sana sampahan ng kaso.. kasi po, ni-loan ko lang ung pera sa credit card ko.. ngaun po namrublema ko kasi naghuhulog ako sa utang na itinulong ko lang naman sa iba. sabi kasi nung nangutang, me sakit daw nanay nya.. kaya kahit di ko cya kilala, nag-cash advance ako sa credit card ko kasi nakiusap talaga.

responde naman po.. please????

Arresto Menor

First, try to locate him then send a demand letter to his last known address. You can bring it there or send it via registered mail with return card.

If he does not pay, you can either file a criminal case or a civil case. A criminal case would be a charge of estafa. You can allege that he deceived you into accepting the ATM as security when he had a plan all along that he would resign. A criminal complaint may motivate him to settle by paying.

If the debt is less than P100k, you can file a complaint with the small claims court. you can go to the MTC and ask for the forms.
