hello po, i just want to ask anu po yung petition for absolute divorce? im marrying a foreigner who is a divorcee, his ex wife is a filipina. divorced for 5 years na, and its already registered in NSO. pero the LCR still require a petition for absolute divorce papers. we have the divorce certificate already. confusing lng po ksi the attorney is asking 30K just for the petition of divorce to be signed by the court. is that really the process po?
any insight will be a great help.
thank you so much!

i recommend the foreigner goes to his embassy to get a certification that he is capacitated to marry.

do you mean that on his marriage certificate, the divorce is already annotated?

We already have the certificate of divorce from the embassy and also the cenomar from NSO.
Do we still need to petition for recognition of divorce?
His filipina ex wife has re-married, we are very confused because the LCR wont accept without the sign from the court.

does this certificate of divorce from the embassy explicitly say that he is entitled to remarry? the thing is, some countries have relative or absolute divorce.

Yes, it is stated on the certificate that he is divorced and unmarried. And he is also certified to marry.
The lawyer that LCR offered said that the process will take up to 6 months.
Its very vague. That's why I am checking on all possible information regarding this.
Thank you.

imo, you should write to the civil registrar himself. they should respect the certification. they have no right to reject the application.

the first step is to get a lawyer who will advice you. the one we handled took about six months.

atty...ask ko lang po kung 150,000 ba talaga ang filing ng petition for recognition of foreign judment? di ba mas madali naman yun kesa sa annulment o pareho lang?

thanks po.

if you're referring to the same one where the petitioner for the divorce was still a filipino, it will be a total waste of money
