Ask ko lng po. I'm a FEMALE pero MALE ung nka X sa birth certificate ko. I was able to get a passport through affidavit of undertaking but I was advised na I won't be able to renew it w/o having my gender corrected thru Court Order. I am already applying abroad and my passport will expire January 2015. Is it possible na maprocess ung correction ng gender ko kahit na wala ako sa country or do I need to be in the country hanggang maayos ung problem sa birth certificate ko? Thank you

You will need the assistance of an attorney to file a petition for correction of entry in court. This will require a hearing, so you need to be present especially during the presentation of evidence.

There is not much of a problem if you marry since the error in you Birth certificate is typo. Make sure though that you marry a man. But for convenience and to avoid future complications better fix your problem by filing a Petition in court ASAP. Find a lawyer first to help you

Hello, just sharing information po..

RA 10172 has been in effect since Nov. 2012, which authorizes the city or municipal civil registrar or the consul general to correct clerical or typo errors on date of birth or sex of a person appearing in the Civil Register without the need of a judicial order. Amendment can now be done by filing an affidavit with support documents.

The petition and its supporting papers shall be filed in 3 copies to be distributed as follows: first copy to the concerned city or municipal civil registrar, or the consul general; second copy to the Office of the Civil Registrar General and third copy to the petitioner.

I am not allowed to post links yet because I'm new to the forum, but just Google RA 10172 to get more details.

In order to resolve your problem, you must file a petition for correction of the erroneous entry in your birth certificate, particularly as to your gender. The petition shall be in affidavit form and shall state, among others, that your true and correct gender is “female” and that your birth certificate erroneously indicates that your gender is “male.”

In order to establish your claim, you must attach in your petition the following documents: (1) a certified true machine copy of your birth certificate or of the page of the registry book containing the entry you are seeking to correct; (2) at least two public or private documents showing the fact that your gender is “female”; (3) your earliest school record or earliest school documents; (4) medical records; (5) baptismal certificate and other documents issued by religious authorities; and (6) a certification issued by an accredited government physician attesting to the fact that you have not undergone sex change or sex transplant (Section 5, Republic Act No. 10172).

Your petition for correction of the clerical error in the entry in your birth certificate must be filed with the Local Civil Registry Office (LCRO) of the city or municipality where your birth was registered, or, if you were born abroad, the same must be filed with the Office of the Consul General where the record containing said clerical or typographical error to be corrected was registered. Please be advised that it is required for you to have your petition published at least once a week for two (2) consecutive weeks in a newspaper of general circulation.

If your petition is valid in form and in substance, the Local Civil Registrar or Consul General shall grant the same. Once your petition is granted and the correct entry as to your gender is annotated in your birth certificate, you may use such certificate in your application with the Department of Foreign Affairs for the issuance of your New Philippine passport.

saan ka po nag apply for passport? we do have same problem

HI, itatanong ko lang if magkakaroon pa ng problema ang NSO ng asawa ko, Male po sia, ang nangyari po kasi, ung "X" is nasa pagitan ng male and female pero mas malapit o nakdikit sia sa male, nakapagpa-passport na po sia, nakapagpa-drivers license at kinasal nadin po kami ng walang mga naging problem, magkakaroon pa kaya ng problema? kasi gagamitin na sa ibang application ang kanyang NSO, like, ipaparedribbon na po namin for visa application. thank you in advance po
