Good day to all. Would want to ask assistance lang po sana regarding sa case ng gf ko.

Nagwowork po ung GF ko sa HR department, in charge of Payroll pero nagwowork din sya sa ibang functions ng HR. Nagtender po sya ng resignation nya with her company last june 19, 2011, reason is that she had some differences with her manager. Pagbigay nya po ng resignation letter nya, sinigawan sya sa harap ng maraming tao, kesyo "Sabihin mo na lang kung ayaw mo ng magtrabaho hindi ung gaganyanin mo ko, etc. etc. etc...". Nag try mo po mag mediate ung AVP nila, kaso dahil nga po decided na rin ung gf ko na magresign, natuloy pa rin po kaso hindi nga po maganda ung pag alis nya sa company, galit sa kanya ung boss nya. Pumasok pa din po sya ng one week after nyang ibigay ung letter of resignation nya para sa turnover ng mga pending jobs, passwords sa systems (programs), files, documents, etc... In short, cleared po sya as in naibigay nya ng maayos lahat ng dapat ibigay sa kanyang successor.

Eto na po ang problema, ung certificate of employment nya pati ung mga backpays is hindi maibigay hanggang ngayon. Ang dahilan daw ng HR Supervisor nya is "hindi pa nga daw naproprocess kasi may mga unsettled clearance na may problema sa computation kaya nakahold na natuklasan daw this september lang. Meron daw problema na may dalawang employees na nagrereklamo na walang 13th month na nacompute na almost 2k na naghahabol daw ngayon."

Part po kasi ng mga ginagawa ni GF is magprocess din dati ng mga clearances, so meron din po syang mga unfinished na pinaprocess nung nag tender sya ng resignation. Pero, naiturn over nya po ito sa kanyang successor.

Arguments lang po namin is:
- Last June pa sya nagresign, September lang nalaman ung problema, bakit since June to September, hindi gumagalaw ang papers nya at nasa table ng manager?

- Names nung mga employees na may problema is hindi naman masabi. She talked with her accounting friends sa dati nyang company at sinabi nila na wala silang natatanggap na problema or complain, same din ang kanilang tanong, Sino ang nagrereklamo?

- Hindi ba dapat ung mga pending jobs na un is ung successor nya na ang gumawa kasi hindi naman na sya connected sa company at walang way or wala na sya sa authority para gawin ung mga bagay na un in behalf of her former company.

Naniniwala po kasi kami na namemersonal ung kanyang manager kaya ganun. Ask lang po namin, kung ilang days po ba ang maximum na itinatadhana ng batas para maibigay o maiproseso ang backpay, clearances, Certificate of employment ng isang dating empleyado. Pwede po bang managot legally ung kanyang dating manager? Ano po ang mga hakbang na pwedeng gawin para maayos ang problema?

if there is continuous refusal, you can file a complaint at nlrc and hopefully they will settle with you by issuing the last pay and docs. there is no legal right to a clearance, but there is for your last pay.
