Do maceda law applicable on my case? 50% Refund?

I just want to ask if I can still have 50% refund as per MACEDA law?
If I paid a downpayment and 7 months of monthly payments?
do refund possible if this is the case?

Can I have some advice on what to do ?

add total payments then divide by monthly installment, is it equal to or greater than 24?

equation...can i refund also?...
i have my 8 mos. down payment, and i decided
to withdrawn...due to their project was not yet develope as per approved plans and with in the limit for development...

naginvest ako ng condo sa megaworld sa newport villamor airbase yung condo turnover 2013 dec.
ngayon nagkaproblema ako financially.. gusto ko sana marefund ung nainvest ko but hindi lahat of course hindi ko naman makukuha ng buo ung nainvest but its okay with me.. pero nung nagconsult ako sa kanila.. may policy daw sila at nakasaad sa contract na no refund policy.tama po ba yun? na kahit nagsign ako ng contract na without my knowledge na hindi sila nagaaccept ng refund.? 2 yrs na ako nakapaghulog thru inhouse. ano po ba ang karapatan ng isang buyer kapag naginvest sa condo? at dapat po ba ang contract is favor lahat sa isang developer? at walang karapatan o protection man lang ang buyer sa isang contract? ano po ba ang maari kong gawin dahil lagi nila sinasabi na hindi nagrerefund ang megaworld. tama din po ba sa isang contract na walang man lang protection ang isang buyer pagdating sa refund?.

ano po ba karapatan ko po dito ?

ITO LANG ANG IDEA KO PARA ME GUIDE KA AT ANG LAWYER MO.

HINDI KA MAKA AVAIL S MACEDA LAW KASI DAPAT 2 YEARS OR 24 MONTHLY INSTALLMENTS DAPAT NABAYAD MO BEFORE KA MAKA AVAIL.

ANG LAW NA PUWEDE MO ma avail is PD 957. kasi sabi mo you desisted from payment because the owner/developer was not able to develop per approved plans and within the time limit allowed by law.

Pero nakasaad sA law is dapat nagbigay ka ng due notice to the owner or developer bago ka nag desist s payments. pagnaka bigay ka ng notice niyan s owner or developer, puwede ka mareimburse s total na binayad mo. hindi lang 50% cash surrender value.

ito ang nakasaad s PD 957.

Such buyer (iyong nakabigay ng due notice at ang reason is failure to develop ng developer per approved plans at within the time limit) may , at his option, be REIMBURSED THE TOTAL AMOUNT PAID (TINGNAN MO. 100% NG NABAYAD MO, HINDI LANG 50%), INCLUDING the amortization interest ( but excluding deliquency interest) plus 12% interest thereon (12% interest s total principal nabayad mo at amortization interest).

summary:


a. principal- - 100%
b. interest s principal
or amortization interest- 100%

+ 12% interest sa letter a and b


pero iyong interest na nabayad mo
dahil nalate ka sa bayad mo s monthly amortization mo, hindi iyan reimbursable kasi kasalanan mo iyan e.

1. FAILURE TO DEVELOP PER APPROVED PLANS
O KAYA WITHIN THE TIME LIMIT ALLOWED BY LAW

2. if iba ang reason other than the failure to develop, maceda law ang applicable if nakapay ka na ng at least 2 years installments
- macedaw law
-50% cash surrender value , and after 5 years of installments, an additional 5% for every year but not to exceed 90% of the total payments made
