hello po. gusto ko lang po kasing magtanong about sa naging scenario ng mga kaibigan ko po at kasamahan sa trabaho. Yung dalawang yun magkashare po sila ng locker sa call center sa cebu. Yung isang kashare nya nagresign na po at pauwi na ng Manila nagkataon lang po na the day na nawalan ng phone yung kashare nya sa locker eh andun din po yung isa kong friend sa office kasi kinuha nya po yung mga papers nya sa locker. Ngayon po tinatakot po siya na baka sampahan daw siya ng qualified theft since na andun siya sa video(cctv) nung nawala yung phone niya. Pero nung tinanong po namin yung isang kaibigan namin ang sabi naman niya eh wala naman siyang nakitang phone sa loob ng locker at kung meron man hindi din niya kukunin yoon. May karapatan din daw po siyang buksan ang locker dahil sa kanya talaga nakapangalan yung locker at nakishare lang yung kasamahan naming isa sa kanyang locker. ang tanong ko po is:

1. Pwede po ba talaga siyang makasuhan ng qualified theft since sa kanya talaga ang locker?
2. Ano po ang pwede niyang ipaglaban kung sakali mang makasuhan siya ng Qualified theft?

i don't believe that the theft, if any, can be considered qualified. the owner is not her employer.

she should focus on proving that there is no proof that she was the one in last possession of the phone.
