Tanong ko lang po, kung meron po nag-file ng case sa baranggay o sa prosecutor's office. May karapatan na po ba ako bigyan ng hold departure order kahit wala hearing o wala pa desisyon ang korte?

good day po. kapag may case po ba sa uae (dahil sa cards or loans) at umuwi sa pinas for good, pwede po bang magfile ang banks from uae dito sa pinas ng hold departure order/watch list order?

sir good day may I ask if you have a case you will send a subpena directly to your home? because i am ofw ihave no case at all but before i leave philippines i had borrowed 5000php with interest to one person and i sign in a paper, but until now i did not pay my wife donot know were to pay this so how woll i konw if this person files me a case, i want to know because bothers me too much. i will pay but when igot home in the phil so that he will be the one to receve . how will i know if this person files me a case will i receive and court papers at home?

francis, you can inquire at the Bureau of Immigration. subpoenas will be sent to the address listed by the complainant.

So hindi po pwede mag-issue ng HDO at WLO ang MTC, RTC o iba pa bukod sa DOJ lang po. Kapag nagreklamo po ba yung tao sa POEA or OWWA ng wala naman sinampang kaso sa korte, pwede po ba magissue or magrequest ang POEA or OWWA ng HDO or WLO?

it is unlikely. only the most serious and sensational cases allow for deportation. it requires philippine government to request it.

Upon issuance of an HDO, how long is its effectivity? Is there an expiry date for this?

When you file a Motion for the Urgent Lifting of HDO, how long does it take for the court to come up with a resolution? Is there a required time for resolution?

How does one follow-up on its status, and how does one ask for its early resolution?

motions are resolved within "a reasonable time period". it depends if your motion has merit in the first place.

Dear atty, nagkaron po ako ng kaso, at naiakyat sa Pasig MTC nung Dec 2000, and it was dismissed on May 2001. Naka kuha ako ng copy of court decision at court clearance nuong 2005 at na submit ko ito sa NBI for clearance purpose - no criminal record ang result. Last May 2011 I renewed my NBI clearance for POEA requirements. This August 5 I will leave for KSA. Tanong ko lang kung posibleng may Hold Departure Order ako sa immigration.

hi atty.good day po tanong ko lang po.my nagfile po sken ng oraldefamation last 2009 pro nkalabas na po ako ng bansa that time.habang nasa abroad po ako after ilang months po lumabas ung case ko with warrant of arrest(oral defamation po ang case)sa town nmin and ung case daw nakaarchive ngaun.plan ko po mgbakasyon ds 2012.pro d po ako uuwi sa town nmin bale sa ibang place po ako magstay for my 1month vacation.if incase po na malaman nla na nkauwi ako puede po ba nla ako ipahold sa immigration,poea and owwa kahit na local case lang yon?thanks a lot po..

romel, i doubt it, but if you want to make sure, inquire at the bureau of immigration.

gracel, if i were their lawyer and i knew you were here, i would make sure that you cannot leave by filing a watch list order and have the warrant of arrest enforced aginst you.

thanks a lot po atty.follow up question lng po uli,so kahit na local case lang po yan puede po nla ako ifile sa watch list order?ang sabi po ung warrant ko daw is dyan lang sa town namin pero kpag outside ng town namin hindi daw ako puedeng iarrest kc local lang.accdg.po yan sa police officer sa town namin.thanks po
