Hi Good day! Can you please cite several difference of reckless imprudence resulting in serious physical injuries and reckless imprudence resulting in homicide? especially as to the penalty. Thank you for your time. This forum is truly very informative. More power to you!

reckless imprudence resulting to serious physical injuries refer to the party involved in an accident and was injured (serious when he/she was hospitalized for at least 30days) while reckless imprudence resulting to homicide is the party involved in the accident died....

Art. 365. Imprudence and negligence. — Any person who, by reckless imprudence, shall commit any act which, had it been intentional, would constitute a grave felony, shall suffer the penalty of arresto mayor in its maximum period to prision correccional in its medium period; if it would have constituted a less grave felony, the penalty of arresto mayor in its minimum and medium periods shall be imposed; if it would have constituted a light felony, the penalty of arresto menor in its maximum period shall be imposed.

homicide is a grave felony so if committed through reckless imprudence, so from 4 month to 4 years, 2 months. serious physical injuries has a range of penalties depending on the nature of the injury, but if it just took more than 30 days to heal, then that is less grave felony and punishment is 1-4 months

Thank you for your response. However, the maximum penalty for serious physical injuries is prision mayor which is considered as an afflictive penalty. What if that is the imposable penalty? Does it mean that, in that case, the penalty for reckless imprudence resulting to serious physical injuries and reckless imprudence resulting to homicide is the same (4months - 4years, 2months)?

as i said, serious physical injuries has a range of penalties. is this hypothetical or is there a real accident? what happened to the injured person?

need advice po. my friend's father died because he was hit by a motorcycle. nagfile siya ng case reckless imprudence resulting homicide. lumabas ang result as kulong plus bayad for the damages. but according sa court, hindi ikukulong kasi nag apply daw ng probation. please enlighten us. ganun po ba talaga ang batas? advice sa amin is mag follow up sa court kung ano ang result from probation office. as of this writing, nagfollow up kami sa court wala pa din daw. two months na nakalipas mula nung basahin yung sentensya. until now hindi pa malinaw sa amin ang mga susunod na mangyayari. please advice po kung ano ang next na hinihintay namin??? wala kaming private atty eversince kaya mahirap mgfollow up ng kami lang. please let us know what to do next.. next.. and next... probation law allows a first time offender apply for probation so he will not have to serve imprisonment, but he still has to pay for the damages.

thank you attyLLL for the immediate response. possible po ba na pati yung damages e matakasan nia? please give us pointers as to WHAT ARE THE THINGS WE SHOULD CLOSELY WATCH OUT FOR or WHAT QUESTIONS we should ask the court pag nag follow up kami? ano na yung next procedure para po guided kami accordingly. thanks again attyLLL. actually wala pa po kami sa ganyang situation na sheriff na kausap namin. waiting pa din kami sa result ng probation office. wala din po kami idea kung pano i didiscuss sa amin ung ganyan. isa pa pong problem, hindi po nmin kilala ung convicted at kung ano meron siya. ano po gagawin namin? matutulungan ba kami ng sheriff sa ganyan? need advise po....june 18 around 2 to 3 am nakabangga ako ng motor at yung angkas ay nabalian ng buto sa may paa.dinala ko sa hospital yung tao at pinadal saken sa phil orthopedic.sinementuhan po ung paa nun tao at sabi ng doctor need daw lagyan ng bakal.at that time la pa aku makuhanan ng pera kya nag sched ang doktor till july 7..nung nag balik kami sa ortho kasama ung tao ng july 7 ang sabi ng doktor tawagan nmin yung agent eh kulang yung dala ko na pera...ang ginawa xray ulit at sinementuhan...nagalit na yung mother ng tao at ang sabi ay idedemanda na ako.pinadalahan ako ng subpoena para sa fiscal at nag punta nman ako kya lng di nag punta ung complainant..ang question ko po ay maari ba ako matalo sa kaso kahet nag offer na ako ng setllement kya lang tumanggi po yung mother ng tao..magkano po ba bail at pde po ba ako mag file ng probation?first time ko lang kasi masangkot sa kaso.....kinasuhan po pla ako ng reckless imprudence resulting to seriuos physical injury..

tini, talk to the sheriff to help. but it's better if you can get info independently.

@attyLLL di pa po bukas pa yung sa subpoena ko sa fiscal po...help nman po kung panu mag apply ng probation para may alam po ako kung matalo po ako..tnx and more pwer po..

attyLLL, if the suspect is advice to pay damages then he has no property but he has a job, can the court request the company to share his salary to the victim???Then can the suspect can still work in abroad coz based on NBI cert he has no pending case or meaning he is cleared?

atty, yes when i paid the bail i have given a schedule for first hearing, but it scheduled almost 4 motnhs from now, but im planning to get a lawyer, is it necessary to get or to talk a lawyer now even though the hearing schedule will be next year pa..thanks

good day atty. i need some legal advice.... i was involved in a vehicular accident last may of 2011. i was driving a 93 model of toyota corolla and the other was a 95model mitsubishi strada pick-up. the owner of the pick-up had file a case against me of reckless imprudence resulting to damage of property... i did not received any subpoena, but last nov 10,2011, i received a resolution paper coming from the prosecutors office stating the case is approved for filing..it also states there that the complainant is asking for an amount of 300k for the repair which is for me is almost the price of the whole pick-up. in my own estimate the repair will range only from 20k to 50k only.

question ko lang po, can i still file a counter affidavit even though nakareceive na ako ng resolution at may case na ako? and papaano ko be pwedeng iprove sa court na sobrang taas nung sinisingil nung complainant samantalang may hawak sya na cost estimate... thanks po

you can file a motion for reinvestigation or motion for reconsideration

follow-up po... i have already filed a motion to reduce bail kasi po may warrant of arrest na ako pero di pa naseserve. im still waiting the approval for that. Right now nakikipagcommunicate ako nung nagreklamo sa akin in a very humble way, ako pa nga nagbibigay ng info kung ano update sa case. dun po sa nakalagay sa resolution ang cliniclaim nya is 300k, i decided to have a talk with him together with his atty. ang layo pa ng binyahe ko but it is ok since ako naman ang nireklamo nya. malumanay naman ang naging pag-uusap namin, humingi ako ng paumanhin sa nangyari at sinabi ko na yung amount na hinihingi nya is obviously sobrang malaki para dun sa damage nung sasakyan (300k for an old vehicle, who's damage is not that great, nayupi lang yung harap? grabe), ang sagot nya sa akin may hawak syang cost estimate galing sa magagandang company na nagrerepair ng sasakyan plus yung payment daw ng atty pa nya, yung abala, yung pinangtataxi nya, kulang pa nga daw yung 300k so ang plano nya is iraise sa 400k. i told him na maliit lag ang sweldo ko at ang dami kong pinapakain sa bahay...i already proposed to him na babayaran ko naman sya basta yung sa tamang amount lang at gagawan ko talaga ng paraan para iutang yun, naiyak na ako dahil talagang parang feeling ko gusto nya talaga akong perahan. so still, hindi ko sya inaway at umalis na lang po ako at sinabi sa kanya na iinform ko na lang po sya at maguusap pa ulet kami. yung nagreklamo po sa akin ay may alam sa batas, hindi sya abogado pero marami syang kilala at experienced na rin sya sa mga proceedings sa korte, and kung mag-iisip lang talaga ako ng masama malamang na sya din ang dahilan kung bakit resolution agad ang natanggap ko at sinasabi doon na hindi makita yung address ko samantalang ang laki laki ng number sa gate ng bahay namin at main street pa at malapit sa korte.

ano po ba ang dapat kong gawin, masyado pong marunong yung nagreklamo sa akin at grabe kung maningil.

nabasa ko po sa isa sa mga post dito na ang madaming mananamantala kapag ang case is RIRI... lalo na pagdating sa pera. attorney, can you give me some pointers.

You have to get your own lawyer as soon as possible. Baka makita pa ng lawyer mo na wala ka palang kasalanan. Kung kasalanan mo man, di naman siguro ganyan kalaki ang dapat sisingilin sa yo. Sa style ng kalaban mo eh mukhang hindi uubra yang magandang ugali mo. Baka kunin ka pa sa technicality.

dlan, the best defense sometimes is to let the case drag on and eventually the complainant will rethink his position. right now he is in a position of strength kaya maangas.

file bail and make the case continue. that is my recommendation
