Bonuses already given was forfeited because Termination is due to non regularization

Hi I would like to ask po about my situation, under probationary po ako effective startinf jan 1 this year up to july 1, bali 6 months po, then na terminate po ako ng june 28 due to non regularization.

ngayon po during the probation po kasi as stated sa contract meron na po 13 mo. and 14 mo. yng mid yr pay.

may leaves dn po na binigay samin at may nagamit nadin po ako na na approve, pero yng bigay na leaves ay nd indicated sa contract.  

then si employer po now is binabawi sa akin ung 14 month saka ung mga approved leaves ko since forfeited daw yun because nd ako na regular.


need ko daw bayaran yun 14 mo at leaves before nila ako bigyan ng certificate and ITR pang clearance


nag apply ako sa ibang company now at ng hinahanapan ako ng clearance wala po ako mabigay,

so ang ask ko po, do I need to really pay for this bonuses na nabigay na? and if I need to pay talaga, is there any other document na maari ko hingin sa past company ko just na mag prove na clear ako magapply ng ibang trabaho, para naman mabayaran ko din yun pinapabayaran nilang bonuses?

leaves are accrued when you have been more than 1 year na sa company. The fact na hindi ka pa regular leaves me to conclude that the leaves were given to you erroneously. If so then kelangan mo nga isauli. Yung sa 14th month tingnan mong mabuti yung contract. Suriin yung mga provisions regarding dun. Usually conditional yun but if hindi then you should be entitled to it.

yan lang po ang indicated dun in regards sa bonuses, pro rated pa nga po pero binigay nila ng buo ung bonus

meron pa sigurong ibang terms sa contract kasi yang sinulat mo doesn't mention 14th month pay. Kung yan lang talaga ang naksulat sa contract then tama sila, kelangan mo isauli yung yung binigay sayo

nakalagay po kasi salary package then meron po 2 mo. guaranteed Christmas bonus and midyear.

wala po conditions like pang regular lang ung bonuses

-Base pay
-Additional bonus and incentive pay of
* 2 mo. guaranteed 13th mo. and 14th mo.
* up to max of 1.5 mo. pay baaed on performance deliverables...

yan lang po talaga, ung nag banggit siya about benefits na convertible sa program nila, ung sa hmo etc

ang prob ko lang po dito is paano naman ako makahanap ng trabaho kung nd dn ako ma clear
