Arresto Menor

Hello po,

Last June 2017, nag apply po ako sa isang private company. Sabi sa MOA, 12 months daw kaming mag training as part of the internship program. Alam ko pong sagot ko ang training costs (training fee at monthly allowance) in the form of 36-months service bond. Hindi po nila masabi kung magkano po talaga ang exact bond fee kaya hindi ako makaalis noong una (may mga sabi-sabi na 200k ang bond. Wala akong pangbayad kaya natakot akong umalis) kaya lang po medyo hindi in line ang trabaho nila sa degree ko at masyado na akong napapalayo sa pamilya ko kaya nag-decide na akong mag resign noong Dec 4, 2017. Ang nilagay ko pong reason sa resignation letter ay "due to personal reasons".

Pagkatapos ko pong magresign, nalaman ko na naging 6 months nalang po ang training kaya naman halos kapareho ko din ng babayaran yung ibang mga kasabay ko. Ngayon po, may babayaran akong 140k pero hindi ko pa po napipirmahan yung "PROMISE TO PAY AGREEMENT". Dito po sa huling agreement (na binigay noong Jan 26, 2018), nakalagay na dapat kong mabayaran ang 140k on or before Dec 31, 2018. Hindi ko pa napipirmahan kasi may isang condition po akong gustong ipabago - yung '... any payment returned by my banking institution for "Insufficient Funds", "Stop Payment", "Account Closed" or any other reason will immediately cause the account to become delinquent and thereafter may result to legal case against me.'. Gusto ko pong ipapalit na at least 2x event na mangyari yon (due to unforeseeable circumstances) saka palang po sila mag legal case for me pero di na daw po pwedeng mabago yung agreement (yun na daw po ang standard form nila to all resigned employees).

Eight months after ibigay yung agreement paper, alam kong di ko pa din afford bayaran yon kaya gusto ko pong magrequest sa kanila na habaan pa ang limit (hanggang 5 years kung kaya) kaya lang po di ko pa naitatanong dahil alam kong sasabihan lang nila ako na yun ang standard form at di pwedeng i-ammend.

Ano ano po ba ang mga karapatan ko bilang isang empleyado? Pwede po ba akong mag demand ng right ko para sa terms and conditions sa agreement? May pag-asa po bang maging invalid yung una naming MOA dahil sila din naman ang unang lumabag dito (6mo instead of 12mo training, 24mo instead of 36mo service)?

just don't sign the agreement at kung gusto nila singilin ka sa bond, idaan na lang nila sa court and there you can negotiate the terms of payment.
