Hello,

Good day!

Nag work po ako sa isang companya na nag implement ng cash bond, before kami ma hire they will ask us na pumirma na we allowed them na magkaltas ng 100 pesos per pay until ma reach ang total amount the 12,000, saka ma stop ang deduction. For sure, most of the applicant ay papayag, sa hirap naman ngayon maghanap ng trabaho lalo na high school or elementary graduate ka lang. Ang reason nila sa cash bond para daw sa damage, nakaw, nawala na issue na tools, AWOL, negative na project. Ang Company namin ay advertising company na gumagawa ng signages. Lahat po ng empleyado ay may cash bond Question: 1. Legal parin po ba ito? Dahil we sign that permit them to deduct for our cash Bond?
2. Pag nag resign ka at nag render properly for 30 days, how many months can we wait para makuha ang cash bond at back pay namin? sa mga kasamahan po namin na nag resign usually po more than 6 months nila ma release ang cash bond at back pay. Reason nila dahil sa mga client namin na hindi pa naka pag fully paid sa project na na handle namin.
3. Pag mag AWOL ka, can you still claim your cash bond at back pay? tapos ang total amount is more than 12k
Hope you can give us advise, kawawa naman po kasi ang mga kasamahan namin na nandoon pa rin sa company. Hindi na nila makuhang mag resign dahil matatanda na sila.

1. DOLE still consider cash bond as illegal
2. law still states within "reasonable" time for the employee to received their final pay (not back pay)
3. yes, mag file ka ng clearance sa company mo.

Thank you so much for your advise, it's a great help!

And may kasamahan din po ako na suspended for 2 months, tapos his planning to resign nalang and look for another work dahil sa taas ng kanilang suspension. Actually, iba-iba ang violation niya they sum up into 2 months. What can he possibly do? mag submit ng resignation letter, tapos mag render ng 30 days after suspension. Or mag submit ng resignation tapos clearance? Please help. Thanks!
