Good day. Just want to ask lang po about sa property ng parents namin. Our mother is still alive and the property is still under the name of my dad We are 10 in the family and i am the youngest. One of my sibling decided to renovate the old house into 5 storey bldg (own decision nya po yan) and each floor has 2 units except for 4th floor because it occupies the whole floor area (no partition)and dun kasi kami nila mom...sabi ng sister ko kaya daw nya pinagawa yung bldg. para daw may kanya kanya na kami. I was young back then so wala pa akong sarili unit and sa 4th floor magkakasama kami nung kapatid ko nagpagawa ng bldg ng mom ko and my other sister. Then I got married, but we still live in 4th floor kasi ayaw nila ako lumipat ng house kasi daw po bata pa and ako ang bunso tas ako pa daw mahihiwalay. Yung nagpagawa ng bldg nakabili ng bahay and she and my brother had this agreement na magpalit kami ng floor...which ako titira sa unit nya sa 3rd floor and si kuya ko sa 4th floor kasi sabi ko malaki masyado yung 4th floor sa amin dahil isa lang anak ko at lagi pa wala sa Philippines si husband. So ayun na nga sa 3rd floor na kami tumira. But after 3 years nakabili si husband ng bahay so we vacate our unit but pinarerent po namin yun. To make the story short...this jan. 2018 na vacant yung unit ko kasi pinaalis nila ng ate ko yung nagrerent and my sister (yung nagpagawa ng bldg.) asked my other sister to ask me if ok daw po ba na dun MUNA patirahin anak nya unit ko (free po ang pagtira nya) till di pa nakakabili ng condo. And this april we ask his son if pwede ba na dun makitira yung anak ko which since bata sila magkasama na sila sa room, naggawa ng eksena anak nya keyso niprepressure daw sya tas pag pinilit daw namin aalis sya sa bldg namin. So nagalit ate ko at sinabihan ako na hindi ko na daw mapapakinabangan yung bahay namin dahil pag umalis daw anak nya dun ipapodlock daw nya yung bahay ko. Now they are claiming my unit as theirs...actually the reason why ako pumayag kasi she said she will send me to Japan and will give me a job and sya daw magpapaaral sa anak ko parang bayad dun sa bahay but she didnt provide for my sons tuition keyso daw di sya ang nasunod sa school na gusto nya...even allowance di sya nagbibigay. And since she failed na pag aralin ang anak ko my other sister ask them to pay the renr instead because thats the only source na mag provide sa need ng anak ko since me and my husband got separated. And she said SYA DAW MAY KARAPATAN SA BLDG NA MAGDECIDE AND SA KANYA ANG LAST WORD KASI SYA ANG NAGPAGAWA SA BLDG. Yung lease of contract po ng mga nagrent ng unit ko nasa akin pa po. Ang question ko po...
Does she have the right kunin yung napag usapan na akin or kahit anong unit dun and does she have the right na magpaalis at mag alis ng karapatan sa property ng parents namin?
