Arresto Menor

Hi. My employer filed a qualified theft case against me way back 2010. It was PROVISIONALLY dismissed and that I must pay them the remaining amount within 24 months with 1% interest. I have not been able to pay it in full yet 'till this day. Would my employer still be able to have me jailed? Please, I need an overview on this. Thank you.
