Dear Atty/Sir/Madam,

Crystal Clear?

SUCCESSION RIGHTS, PROTECTION OF CHILDREN

Are the Domestic Adoption Act RA8852 (1998)(S13,16-18) and New Rule on Adoption A.M.02-6-02-SC (2002)(S16,17,19) clear, for a lawyer or a lay-person to understand, that an adopted child's successional (inheritance) rights are de facto retroactive to the date of petition once the adoption decree is final and executory and after the mandatory reglementary period has expired? If not clear, how can it be shown to be clear?

During the reglementary period, to what court and on what grounds can a domestic adoption can be contested? Can the birth parents contest it with a view to it being revoked?
