We didn't qualify for a bank and PAGIBIG loan.
We cannot pay the amortization through in house financing.

My parents decided to give up the condo unit, its still brand new. Write a letter to the developer saying we will voluntarily surrender the property. Are we going to be sued by the developer?

We are not after the refund anymore since we paid less than 2 years.
