Hi!

I am planning to open a yaya/maid agency in our province and I would like to have it legalized with the necessary permits.

I do have questions in relation to the new KASAMBAHAY LAW:

1. What if the client refuses to follow the conditions set in the KASAMABAHAY law such as enrolling the maid in SSS,PHIC and PAG-IBIG, will the recruitment AGENCY be held liable in case if the yaya/maid complains in court for non-compliance?

2. Is there a need for a document of an agreement that needs to be done to waive the responsibility of the agency in the event that the client/employeer viloates any rule in the KASAMBAHAY law?

Please do enlighten me.

As I understand, the kasambahay will be the agency's employees, and not the client's. Thus, it is the responsibility of the agency, and not by the client, to register the kasambahay with SSS, Pag-IBIG and PHIC.
