Good day po sa lahat. i need some legal advice po sana para sa kaibigan ko. dati syang nag trabaho sa isang pawnshop, ngayon po. may nag sanla sa kanila ng alahas. ung appraiser po nila kinumpirma na ok ung mga alahas. yung friend ko naman po sya ung gumawa ng mga resibo para ma-release yung pera para dun sa sinanlang alahas. ang problema po. fake po yung mga alahas na sinanla. so ang nangyari po yung friend ko yung kinasuhan nung may ari ng pawnshop dahil nag tago na po yung appraiser. qualified theft po ang kinaso sa kanya. tama po ba un? kahit wala naman syang kasalanan? sa kanya pinasa yung kaso. ang problema pa po. sa lahat ng branch nung pawnshop ang binilang nila nung nag audit, kung saan na assign ung appraiser. kaya umabot daw po ng 22M ung total na nawawala.

maraming salamat po sa sasagot at tutulong.

Sa company policy ba hindi pwedeng mag issue ng resibo si appraiser? kasi kung pwede naman eh maaaring palabasin na meron silang sabwatan.

better advise your friend to lawyer up since this is a huge amount and the pawnshop will probably proceed with the case.

My take is this: The theory of the pawnshop is that your friend and the appraiser are in conspiracy with each other to defraud them. The defense of your friend is that he/she relied on the appraisers examination that the jewelries were genuine. Most likely the prosecutor will find a probable cause against your friend and the appraiser, and they will be charged in court. Qualified theft has no bail. Your friend will be in jail while the case is being tried. But it is incumbent upon the prosecution to prove that there was a conspiracy. My advise is for your friend to find a good lawyer.

Correction: Qualified theft may be bailable, depending on the imposable penalty, which is dependent on the value of the stolen property. But if they intend to pin the entire P22 million on your friend, that will certainly not be a bailable charge.

Your friend should consult a lawyer in the flesh.

what if the amount is only 1,110? ano po possible penalty nun kapag na convict? nakapag bail nman po ako nang 40,000.

Good day po! Help naman po i need ur legal advice.. I have a friend na nakakuha ng pera s bank kung san cia nagwowork amounting to 700,000..he already admitted his mistake.. Pero nakapag partial na po cia ng 400,000..ngaun po he was already dismissed in his job.. And he was informed na itutuloy po nila ung case against him.. Pwede po ba mapigilan ung case na ifile? If ever na ma arrest po cia bailable po ba un?
