Hi,
during my marriage with my ex-husband I constructed a house in my mother's small lot through my own money. My ex never left the house so I went abroad to stay away from further argument and fight. I learned from neighbors that he and his girlfriend/wife are staying in my house. My problem is he always tells me I can't kick him out of the house because it is a conjugal property. Is he correct to say that? What will I do to kick him out since he never contributed to the construction of the house and besides the tax declaration is under my name. And during our marriage he applied loans and forged my signatures without my knowledge. Can I still sue him? Any advice is greatly appreciated. Thank You

I don't know the rules for property after nullified marriages, but I SUPPOUSE the nullification CANCEL all, which came by marriage.
IF so:
The property isn't conjugal.
You don't need to support him.

Bring it up with the Barangay Captain. He has jurisdiction to decide evictions and tell the police to assist.

How come it's in your name, if it's your mother's lot? IF it's just because you pay the property tax - Did your mother pay it earlier?
Do you pay any rent to your mother for the land?
Is there any contract between your mother and you?

That's criminal,
but if it's only tax declaration, it isn't ok to use it as collateral.
Have you lost any money by it? If so - what happened?
