Hi!
We are call center agents our employer is not paying Night differential considering work hours falls between 10pm to 6am. money claims has been filed. But they insist our night differential is already included on the basic pay that we are receiving on pay days. Contract does not say that night differential is included in our basic pay. Also included on money claims are night differential on hours worked during overtime (rest day, holiday) holiday premiums are not paid if holiday falls on a rest day.

By the way company put us on a floating status without due process. They called a meeting one week after our last day of working asking to signed a paper that we our agreeing to be on floating status without pay.

Yes, as long as you can contradict the contention that such pays (Night Diff and premium pays) are included in your salary. All you need is to do stipulate this fact in your complaint/reply and insist that the same are not part of your basic pay.
