I have a question. So my brother pregnated a woman. They lived together for about 2 years but the the thing is that the woman forced my brother to have sex with her knowing he was really drunk. He doesnt love her, and he couldnt love her for the fact that the woman has no good manners and also her family. Their relationship was very rocky. My brother met a new woman and he loved her so much that he married her and they had a child. My brother's son is living with her mother. So the thing is that my brother is a seafarer and he asked our mom to take good care of his son. My brother provides all the needs of his son, enrolled unto a good school, provide his basic needs. Giving him all the love and care. My nephews mom doesnt want his child to see us or even talked to us. They only let my nephew visit us when they dont have nothing to feed my nephew or when there are expenses at school needed to be paid or when his sick. We would always call the boy to come to our house but whenever his with his aunt the boy never answers or even looked at us. They would scold my nephew whenever they sees him talking to us. Before the mom has no job. All the expenses of my nephews are paid by my brother. Now the mom has a job as a domestic helper and left my nephew to her sister. Sometimes my nephew cries because her aunt wouldnt let him be with us. Teaching my nephew not to talk to us. They usually tell others negative things about us saying that we dont love the child, we dont provide him anything. What they want is to give them money for the child. My brother doesnt want to give them money because he knows that the money wouldnt be given to his child but to the womans family. Knowing they will use it for there own wants. The child just turned 7. We want the child to be in my brothers custody. Do we have a chance?

Your brother had 2 child. The first child is an illegitimate one and the next one is legit.

To which one is your question for ? I mean, from your last sentence, which child you are referring to?

Hindi mo naman nabanggit na kayo ay ikinasal ng ina ng mga anak mo. Ibig sabihin, ang mga bata ay illegitimate.

Visitational rights sa mga bata ang isang maaring ilaban mo sa court at pirmadong transaction/resibo/katunayan ng pagsuporta naman ang humigit kumulang ang maaring depensa mo sa maari nyang isampa sa iyo.

yes po.hindi po kami kasal at hindi pokami pwedeng ikasal dahil kasalpo sya sa unang nyang asawa...pero sabirthcertificate ng anak kpo nakapirma at apelido k po ang gngmit ng anak ask klng po din ung tungkol sa kasulatan at pirmahan nmin dlwa ay legal din po nakasaad po dun ay hiraman po kmi sa anak m 1 week saknila at 1 week sakin at lahat ng gastusin ay ako po ang nagsshpulder!!curretly po buntis po sya ulit at almost 2months k na pong hindi nhhram nakikita at nkkssma ang anak anopo b dapat kong gawin sir paalisn po k ulit hindi k man lang maksama ang anak k!legal po b ung kasunduan at pirmhan nmin dlwa pwede kpo bang gamitin un hindi posila natupad sausapan!!salamat po

Tulad ng nabanggit noong una, visitational rights ang maaring mong idasal at ilaban sa court na kung saan payag ang ina ng bata, dahil ang bata ay iyong illegitimate child sa kanya. Ito ay para legal mong madalaw at mapasyalan ang iyong anak sa madaling salita basta ma approve ng court ang iyong petition.

Maari mo sigurong ilaban ang temporary custody ng mga bata sa tuwing ikaw ay magbabakasyon sa Pilipinas at ito ay iyong hihilingin din sa ina ng bata sa loob sa court.

i just wanna ask ,i have one kid 5 years old im not married to tbe father of the child but we are separated last year.im here now in other country i have a chance to get my son and bring him here so i had vacation last august last hear i talk to the father about this and he agreed with this we went together to notary to make and paper of consent he sign it ,he write also in paper and sign ,he give also the copy of id and he give his nso birth certificate, but when i come back here in other country he change his mind he dont want it anymore to give to my son he said i can do anything even i kill just for my son ,,,,what can i do this ,i give a complain also in barangay police because he hurt me physically i had my medical certificate also but because he agreed with me i did not containue the complain but now he change and he making me afraid of killing which makes me crazy to think, i said to him i will help you what you want just to have a good talk about our son,he wants to borrow 20,000 pesos but i said i dont have yet and i will give you when i will come there to get my son,but he change,now my question is what can i do if he dont want to give to me my son and about what he saying that he will kill one of my family,,,?your answer will be very appreciated, thank u!!

My opinion says, get a timely schedule to fly back in Philppines. Find a good attorney and file a case to have custody over the child and a case against the father of the child.

Your attorney would give you legal advise further and tell you which cases are probable to file. GL

As the mother of illegitimate child, you have rights to file/demand FULL custody and parental authority over the illegitimate child in court and even bring your son to your country of work, as long as the child is safe and well taken care of. You can also file a court case of non-financial support of the father over the child if the father is not providing any.

On the other hand, the father may file in court his visitational rights over the illegitimate child if the child would still stay in Philippines.

The child is illegitimate. If there are no evidence that the safety and welfare of the child is at risk with the mother or court finds no compelling reasons for the child not to stay with the mother, thus mother has full authority and parental consent over the illegit child. If child's mother is not around or available, I think its the next to kin of the mother like her parents or siblings. There are more in line rather than the father of the illegit child.

If you find that the illegit child's safety and well being is at risk when he is with his bio father, you must prove that also in court. If not, father may ask his visitational rights over the child and court may grant that if that is the case.

If my son will stay in my parents and if the father wants a visit rights what if i give him a right to visit but he needs to support financial is that possible?and if he dont want to support financial is it possible he cant have his right to visit also?thank you,

Visitational rights and financial support can be discussed and decided in court once you file a case against the father or a case for full child custody

The father is supposed to provide his obligations to his illegit child by at least sending regular financial support. The law requires that. If not, file a case against the father for non-support.

Also, it is a child's right to see his bio father while he grows up. It is beneficial for the child to his fatherly image (unless there are compelling risky reasons not to.) whether father has work or not, or father is sending financial support or not. Thus, father prays for his visitational rights in court. (Not to cause flamewar and no disrespect meant, I noticed from other forum sites that most women cannot accept this fact or doesnt understand this part for unknown reasons I could not fully understand).
