The child is already illegitimate from the start since the mother had the child before marriage and the mother did not use the father's surname. To claim child support she will need a paternal test (DNA) to prove that the husband is indeed the father of her child.

kahit po sa mga chat nila eh inaako ng kapatid ko na anak nya ang bata? Pde pa din po ba gawing beneficiary ng kapatid ko ang bata sa SSS, PhilHealth at insurance nya kahit hindi nakapangalan sa kanya ito?  Yung hipag ko po eh nagdedemand na 50% ng kinikita ng kapatid ko ay mapunta sa anak nya. at ang bahay ng kapatid ko na hindi naman nakapangalan sa kanya ay pinag iinteresan din ng babae at pinapalagay sa pangalan ng bata. And yung bahay po eh binili nung kapatid ko sa lola ko nung binata pa sya pero walang deed of sale at walang transfer of title (complicated).

Even IF he will be found having to pay child support, 50 % is far to big part.

(Most of the rest I don't understand, because my understanding of Tagalog is bad.)
