Dear Atty,

Meron po kasing nagkautang sakin at nagbigay sya ng 3 PDCs, 1 for each month. Bago ko po maihulog yung 1st check ay tinawagan nya ako at sinabing sarado na raw yung account nya dun sa bank na in-issue nyang check sakin. Dapat ko po bang ideposit pa yung mga checks at hayaang mag-bounce para may katibayan ako? Estafa po ba o bp22/bouncing check ang pwedeng i-kaso ko sa kanya? Civil or criminal case po bang matatawag ang bouncing check?

Meron po ba kayong maire-recommend na lawyer to help me file the case?

Marami pong salamat at mabuhay po kayo.

moderator

i recommend that you tell that person that if he does not pay, you will deposit the check and if it does not clear, you will file criminal case of bp 22 against him. hopefully, he will pay.

Actually Sir attyLLL sa tagal ng pakikiusap ko sa kanya eh lahat na ng checks ay nag overdue na. Natatakot lang ako na baka maging stale checks ang mga ito wala akong maging evidence para sa kaso. Pwede pa po ba itong gawing evidence for bouncing checks kahit alam kong sarado na yung account nya sa bank?

moderator

if you don't deposit them, you will not have proof that the account is closed, and you will be deemed to have waived your right to file a case of bp 22 if they reach more than 6 months.
