Hi Attorney, Good evening po sa inyo. I'm so glad that I found this free legal advise as I'm looking for the one who can answer my queries.

Ito po ay tungkol sa lupa ng aking lolo. Patay na po sya at ito ay naiwan sa mga anak. 9 po ang anak ng aking lolo at yung nanay ko po yung bunso. Sa ngayon 4 na lang po sila natitirang buhay at sila po ay matatanda na rin po. Ibenenta po ng aking nanay ung lupa na nasa 1 hektaryang sakahan at kasama na po dito ang paguusap usap po ng magkakapatid para sa pagbenta ng lupa.

Ngayon po, may isa po akong pinsan na anak ng kapatid ng nanay ko na kung saan patay na po yung nanay nya. Sya po ay nagfile ng complain at kinasuhan po yung tatlong magkakapatid ng pinsan ko na yun at kasama po nanay ko dun. Gumawa po sya ng sulat at pinapirma nya ung iba ko pong pinsan na namatay na rin ang magulang. Pumirma po yung iba kong pinsan dahil ang pagkakaalam nila, ay meron lang ibebentang lupa na hindi nila alam gagamitin na pala pangkaso against sa mga tiyuhin ko at sa nanay ko. at ngayon nagpaplano po kame kasama ng pinsan ko na gumagawa ng letter para magback-out sa pirma nila. halos karamihan po ng signatures ay silang magkakapatid na nagfile ng kaso.

Tanong ko po:

1. Pwede bang maging counter affidavit kung pipirma sila sa letter na they are force to sign without telling what's the context of the letter?
2. Kung yung pinsan ko nagfile ng kaso lang yung nakapirma kasama asawa at kapatid nya, is that still a strong motion to file the case?
3. If we are going to give back the money to the buyer, do he have still case to sue? what is our suppose action here?
4. If the money that was received from the buyer used in renovating the area of the deceased siblings in the cemetery where in fact his mother is included there. Can we use the receipt as evidence where the money was used?

Appreciate if you could advise.

the reason kaya nagfile ng complaint ang pinsan mo is to get what is theirs,,
and tama cla, meron cla share doon, kahit na wala na parents nila(inheritance by representation).
mali ang ginawa ng nanay mo, at kahit walang pirmahan, sa actual na kaso, meron right ang pinsan nyo to contest the selling without giving them their share, regardless kung saan pa man ginamit ang pera... malay nyo, gusto pala nila bilhin, bakit di cla nabigyan ng info....

ang the best na gawin nyo, mag usap usap at liwanagin ang fair share ng bawat isa,, wag counter cases,, pare pareho kayo maabala..
