Pag gumawa po ba ng compromise agreement tapos pumirma na siya sa affidavit of desistance then na dismiss na yung case pwede pa po ba siyang magfile ng case na parehas sa last na finile niya? double jeopardy po ba ang tawag dun? Maraming salamat po.

Bigamy atty. dinismissed na po yung case kc nag desist na siya sa case then nag compromise agreement po sila hindi na po umabot sa mediator kasi aalis na po yung father ko pupunta ng ibang bansa para may pangbayad sa kanya kaso hindi po natupad yung date na magbbyad ng 200k bali 100k lang yung nabayaran kasi kulang yung pera.

look at the decision dismissing the case, whether it was provisional or with prejudice. if with prejudice, it cannot be revived. if provisional, it depends how long ago the decision was issued.

Atty akala ko po ang bigamy case ay di nadidismiss? kasi po the crime has been committed already.
Bakit po sa case na to ay naiurong ang case sa pamamagitan ng cash settlement? at ano po ang mediator?

note that it was not clear whether there was an actual order of dismissal and what stage this was in the proceedings.

a prosecutor is not bound to dismiss a case by the mere desistance of a private offended party. a criminal case has the State as the complainant, not the private offended party.

Kung ganon Atty, paano procedure kung gusto ng iurong ng private offended party ang demanda? Ano ang papeles na dapat makuha ng idinimanda para mapanghawakan na umatras na ang nagdemanda sa kanya? Pagkatapos nito malinis na ba sya, mawawala ba ang mga police record nya at iba pa? Salamat po sa inyo.

again, it depends on the prosecutor. there are certain crimes where the prosecutor will be unable to prove the case if the witnesses and the private offended party desist.

bigamy is not one of these cases. if the private offended party desists, bigamy can still be proven by the two marriage certificates. if i were the prosecutor, i'd have the nso subpoenaed and have them certify to the certificates. that's it and rest my case.

you can pay the offended party and they may desist, but there is no 100% guarantee that the case will be dismissed.

there are lighter crimes where the civil aspect can be validly settled such as reckless imprudende, estafa, bp 22, etc, but bigamy is not included.

Good day!!gusto ko lang sana magtanong about sa processing ng clearance tungkol sa nakapagpiyansa na ngyong araw na ito Sept 22,2011 sa isinampang reklamo na Qualified theft at nagbayad ng pyansang P20,000. Ang nangyari ay nakapagpiyansa na ang akusado binigyan siya ng "Affidavit of Disestance" ng complainant,,,ang naging proseso ay ipapa notaryo sa Fiscal,,at pgkatapos submit yung papel sa RTC,,and then ang sinabi sa presinto set nila sa Martes yung hearing...Hanggang sa ngayon nakakulong pa yung tao sa presinto BJMP...Ask ko po kung bakit hindi p pwede ma release kasi madami pang proseso sila gagawin,,at may hearing pa na magaganap.Ang nasabi sa amin ay yung clearance para sa paglabas ay manggagaling sa BJMp..Ang problema po ay sa Martes p dadating ang judge para sa hearing at sa kanyang pagpirma..Ano po ang tamang gawin para makalabas na....nangangailangan po ba ng hearing kung inuurong na ng complainant yung kaso at nakapagpyansa na rin ,
salamat po sa inyo..sana mapayuhan nyo po ako sapagkat kami ay naguguluhan...

if the judge is not there, you can file a motion with another judge of another court to grant bail
