TAX REFUND..

Hi, I'm Sid Caezar. Regarding tax refund? I was hired October 05, 2014 and it ended 1st week december.. the total tax deducted during my entire stay is 2,400. Lat december, they told me that my tax refund will be available by january, but I was surprised when they informed me yesterday that i just need to wait because they haven't receive the report from BIR yet... Is this legally correct? they even told me that I won't be getting any 13th month pay cause even i was hired oct-dec.. the number of days that i reported to work has not reached 30 days.. so i won't be getting even a 1-month prorated 13th month pay.. I'm just concerned to know my legal options regarding this matter.. Hope you can help me out.

You are entitled to a prorated 13th month pay as long as you were employed for at least 30 days.
