Hours of Work

Sa normal hours of work ba na 8 hours a day or 40 hours a week, kasama ba dun ang sunday? Kasi sa amin required kami to report during Sunday. Or applicable lang ang 40 hours from Monday to Friday lang? Thanks.

What i mean is, start ng duty namin is sunday then usually ends during thursday. Pag mag duty pa ba ng friday, which is the 6th day of duty is overtime na?

40 hours kahit anong araw ang sakop basta meron kayong rest day.

Ganun bah. Sabi kasi ng hr namin applicable lang daw ang 40 hours from monday to friday. So kahit pang 6th day namin ang friday na duty, di daw yun overtime kasi nga weekday.

Is it valid na may ruling ang company na ang coverage ng 40 hours na work per week is from monday to friday only? Please enlighten me on this. Thanks!

the duty of every employer, whether operating for
profit or not, to provide each of his employees a rest

(b) The employer shall determine and schedule
the weekly rest day of his employees subject to
collective bargaining agreement and to such rules and
regulations as the Secretary of Labor and Employment
may provide. However, the employer shall respect the
preference of employees as to their weekly rest day
when such preference is based on religious grounds.

Actually, di masdayo defined ang rest day namin kasi pwede cya anytime of the week depending on our production schedule.

Duty as scheduled: sunday to thursday. 8 hours per day.

32 hours of work (monday to thursday)
8 hours of overtime (sunday duty)
8 hours undertime (kasi ang definition daw ng 40 hours of work is from monday to friday only)

ang overtime work ay lagpas 8 hours ng regular work day or work on rest day.

Yes. Kasi nga monthly paid kami. And for the company ang definition ng 40 hours per week is the number of hours worked during monday to friday only. So even if we started working on sunday to thursday, kulang parin ng kami ng 8 hours kasi di naman kami pinapapasok during friday. So undertime ka ng 8 hours and may overtime ka na 8 hours sa sunday.

Bale di daw kasama sa counting ng 40 hours per week ang duty during the first day dahil sunday daw. Only from monday to friday.

So sa Friday "absent" kayo?

Pag "overtime" kayo sa Sunday, may dagdag na bayad?

Yah absent kami pag friday and may dagdag na ot pag sunday. Kasi di ba dapat wla ng kaltas since sunday nag start ang duty and nag end ng thursday. Bale 5 days na ang duty a total of 40 hours na. Tama bah?

Pero kasi... undertime cannot be offset by overtime...

Gina equate kasi ng hr na ot ang sunday which is hindi dapat. By defn ang ot is work beyond 8 hours..

aRTICLE 93. Compensation for rest day, Sunday or holiday work. - (a) Where an employee is made or permitted to work on his scheduled rest day, he shall be paid an additional compensation of at least thirty percent (30%) of his regular wage. An employee shall be entitled to such additional compensation for work performed on Sunday only when it is his established rest day.

So dapat kasali cya sa 40 hours kaso nga lang may additinal compensation. Di bah?

If you have 5 days work and 2 days off, then you should not have any deductions, but no overtime also.

How about ang ruling ng company namin na ang sakop lang ng 40 hours na work is during weekdays only that is from monday tp friday only? Is it valid?

Bcoz that is their definition sa 40 hours na work applicable only mon to fri. Any work rendered during sat and sun not credited sa 40 hours na work...
