Hi! Umupa po ako ng room in quezon city. Humingi po sila ng one month advance, one month deposit sa akin. Then recently po nagkaron ng dispute since nagpatuloy po ako ng kaibigan for a few days at nagbreach daw po ng contract. Then nung nagsabi po ako na lilipat na lang ako, di nya na raw po ibabalik yung deposit since nasa contract daw po namin eh at least 30 days dapat eh magnotify ako. So icoconsider nya raw po yung text ko as the notice then yung deposit as my payment for next month, wheter I stay or not.

Eto po yung items in the contract pertaining to our case:
2) The duration of this contract is 1 year commencing on 4th of April 2014 and anding on 04th February 2015, the lessee shall have the right, to evacuate the leases premisses by giving a written notice of his wish to do so at least one month in advance. The contract shall be renewable for similar periods with the same conditions, unless either party notifies the other in writing of his intention not to renew, at least one month before the expiry date of the contract.
7) The Second party is not entitled to sub-lease or assign all or part of his lease or take any other person as an associate, without having first obtained the prior written permission from the first party. only the registered resident as per this rental agreement are allowed to reside in the premises. In case of breach, this contract shall be considered automatically terminated and the second party shall vacate the premises at the owner's discretion.

Pwede ko pa po ba habulin yung deposit ko? O mas lalala lang po ba yung dispute kung hahabulin ko, and if ever, meron po ba silang habol sa amin, like kasuhan ng trespassing yung pinatuloy ko or damages or anything? Thanks in advance!

It seems na malinaw ang terms ng contract.

Check the contract anyway for the parts about refunding in case of termination of contract sa paragraph 7.

Pero malabo kang mabawi ang deposit.

Eto lang po yung nakalagay pertaining to the deposit:
4) The second party has, before signing the contract paid a security deposit (Bond) of PHP5000. The sadi bond shall be refunded only at the end of the lease, subject to the return of the premises in the same condition it was originally received, and to reinstate its own original condition at his own expense except normal wear and tear. Or, the first party shall have the right to deduct from the said bond an amount equal to the damages suffred by the premises as a result of the use thereof by the second party. In the event where the bond is not sufficient to cover the damages, the second party shall pay the assessed amount forthwith.

Aside from that wala na pong item pertaining to the deposit in the case of termination of contract. Kahit po ba terminated na yung contract eh pwede nya pa rin iinsist yung item 3?
