Dear Sir,

We are living in Bulacan. Our property is classified as farmland and so is our neighbors.

Last week, our neighbor had made a 1.5m x 1.5m open cesspool on his property without any concrete walling. This was for the waste materials generated from his piggery of 25 piglets. The cesspool was just 12 inches away from our concrete perimeter wall. The liquid waste material from this open cesspool has seeped through and is now leaking inside our property. What aggravated the situation is that his land is elevated 2 meters from ours and so, the leakage would cover the whole human height more the 6 meters wide.

We communicated our concern with the owner but he said, "wala akong magagawa dahil sa lupa ko naman ito hinukay." Since we know that he deliberately made this cesspool very near to our wall to infuriate us, we did not discuss further.

Sir, Here are my questions:
1. What are the basic laws governing construction of a cesspool(backyard hog raising)?
2. What would be my best baranggay level recourse?
3. What would be my best legal recourse?

oh, i'm no agri law expert, but the civil code provides the remedies for nuisances.

i recommend you first visit the municipal health officer and file a complaint that this is affecting your family's health. they will have powers to shut down the piggery if warranted.

if that doesn't work, then go to the barangay to file a complaint. then you can escalate to court to abate the nuisance.
