Hello,

I would like to ask if it is legal for an employer to issue a contract that states it is a probationary contract lasting 3 months. As opposed to issuing an employment contract with corresponding probationary period clause included?

It also does not mention what will happen after 3 months. And it is not a project based contract. The person involved is being hired as an owner's rep by the foreign owners.

The company is just starting here in Philippines so perhaps the owners are not very familiar. But that is of course another topic.

usually, probationary contract comes first.. then after a satisfactory performance, then a regular employment contract is offered..
