Hi. Bagong call center agent lang po ako. yung napasukan ko na kumpanya ay merong clause na nagbabawal sa mga emplyado na mag-tatag ng unyon. tantamount to termination ang penalty sa unionization.
multi-national BPO company po itong napasukan ko, pero dito na sila nag-ooperate sa pilipinas. . .di ba dapat sakop sila ng philippine law? di ba violation ng section 8 ng bill of rights ang pagbabawal ng pag-uunyon ng manggagawa?

on its face, i'd say that clause is void. you can file an anonymous report to the DOLE with a copy of this clause. hopefully, they will use their visitorial powers.

on the other hand, are you guys planning to form a union?

marami pong mga beteranong agents ang nais mag-tatag ng unyon. eh, yun nga lang po marami ang naiintimidate sa clause na kasama sa kontrata prior to employment...
me estimate po ba kayo attorney kung gano katagal mareview ng DOLE ang complaint namin kung mag-pafile kami ng anonymous complaint?
