Good day Attorney!

Mag seek lang po sana ako legal advice. Mayroon po akong 5-year old daughter, hindi po kami kasal at hindi na rin po kami nagsasama ng nanay ng bata since 2010. Inacknowldged ko po yung anak ko by signing as a father doon po sa birth certificate. Sabi po ng nanay ng bata na kailangan ko raw magbigay ng P5000.00 buwanang sustento or else, hindi raw po nya ipapakita or ipapahiram yung anak ko. So for the past few years wala po ako choice but to obey her demands just to be with my daughter.

Ngayon po, may MGA instaces po kasi na iniiwanan po yung mga bata (may isa pa po syang anak na babae, age 7 yrs. Old) sa kapit-bahay, na siya ring nagseservice po sa mga bata sa school. Madalas po ay iniiwanan yung mga bata ng 1 week sa kapit-bahay at paalam na may aasikasuhin lamang. Napag-alaman ko po sa isang social-networking site na sila ng kanyang mga kabarkada ay nagbabakasyon sa boracay, Puerto Galera at recently po sa Hong Kong at China. Madalas din po siyang nagpopost ng mga gimik nilang barkada sa mga bars sa metro manila. May mga post din po sya regarding sa kanyang habit na smoking at balak na saktan ang anak ko dahil sa madalas na di-pagsunod sa kanya.

Hanggang sa kasalukuyan po ay wala raw po syang trabaho.

Tanong ko lang po Attorney, enough grounds na po ba yung mga nakasaad para makuha ko po ang SOLE CUSTODY nung anak ko? Ano po ba ang mga hakbang na dapat kong gawin.

Sole custody? Dream on! If you are not married to the mother of your child, you have no claim for a sole custody of your child, but you are obligue to give support. Whatever she does in her life is none of your business! If she assigned someone to take care of her children is her choice.
On the other hand, if you have proof that she is maltreating your child then you can report her for child abuse and DSWD will be dealing with her and take care of your child NOT YOU!
