Arresto Menor

Art. 332. Persons exempt from criminal liability. — No criminal, but only civil liability, shall result from the commission of the crime of theft, swindling or malicious mischief committed or caused mutually by the following persons:
xxx
3. Brothers and sisters and brothers-in-law and sisters-in-law, if living together.

Ask ko lang po:
1. kailangan ba na ang magkapatid ay nakatira sa iisang bahay para maging saklaw ng probisyon na ito?

2. Ang tinutukoy po ba ng phrase na "if living together" ay brothers-in-law at sisters-in-law lamang? O kasali rin ang brothers and sisters?

Yes, kailangan iisang bahay ang tinitirahan ng magkapatid ayon sa Article 332.

Yung qualifying phrase na living together ay applicable pati sa brothers and sisters by affinity (yung magkadugo)

Correct na sana yong huling statement except that the added phrase: "by affinity" - is wrong. Replace it with: by consanguinty or blood relationship.
