For cutting his client's hair during a hearing to mislead a witness, a lawyer has to face trial in court.
Lawyer Abrahan Acosta was indicted by the Cebu Provincial Prosecutors' Office for violation of Presidential Decree 1829 or the Obstruction of Apprehension and Prosecution of Criminal Offenders.
The charge was filed before the Regional Trial Court.
“Indeed, respondent in cutting the hair of the acused contributed to distorting the very appearance of the accused, making it impossible for eyewitnesses to identiy him,” said Assistant Provincial Prosecutor Ryan Gingoyon said in his resolution.
Abraham is the legal counsel of Junydale Edano and Galdys Sinangote, who are suspects in a murder case.
During an inquest proceeding last March 11 in Bogo City, the lawyer was seen hurriedly cutting off the hair of his male client.
The client was about to be identified by a witness during the proceeding.
Senior Insp. Rully Monsanto Lauron, police chief of San Remigio town in northern Cebu, filed charges against Acostra for trying to derail the investigation.
In his affidavit, the police chief recalled that during the inquest proceedings at the Municipal Circuit Trial Court of Bogo City, a witness, Jea Ybañez, was about to identify the lawyer ’s client as a suspect in the murder case.
The witness, however, asked for a break so she could rest first.
The police officer said that while he was on his way to another room to get the other witnesses, he saw the lawyer in a hallway hurriedly cutting the hair of Edano close to the scalp to make him look almost bald..
The police chief said he believes Acosta tried to “alter , destroy, suppress or conceal” evidence.
Court stenographer, Marilyn Piape, also executed an affidavit, stating that Lauron borrowed a pair of scissors from her which was used to cut his client’s hair.
