Atty, itatanong ko lang po kung meron pong subsidiary imprisonment if someone fails to pay the damages arising from a crime awarded by the court?


Correct me if I am wrong atty, kasi ang pagkakaalam ko lang po is that may subsidiary imprisonment po pag hindi po kayang bayaran ang fine in a criminal case... Yun pong 1 day for every Php8..

I hope you can help me enlighten me about this matter.. Thank you..

Your understanding is correct. There is no Subsidiary imprisonment in case of damages arising from crime. What the complainant seeks here is payment in terms of money.

Salamat po sa pagtugon atty tsi ming choi... Actually, I am not a law student.. I am just a person who loves to read law books.. Unfortunately, may mga legal jargons po akong hindi naiintindihan that only lawyers siguro ang makakasagot..

Paano po kung hindi makabayad ang defendant ng damages, what I mean po is that INSOLVENT na po siya..Ano po ang mangyayari?
