hi atty. ask ko lng pu. nkpagshoplift kc pu ako ng goods worth 400 pesos. nhuli ako ng guard and dnerecho ako s security office nla. isinoli ko lht ng mga knuha ko tpos mron clang pna-sign up n form sakin. tapos pnpbayad ako. tnanong ako nung officer kng mgkano daw ang kaya kong ibgay. ngbgay pu ako ng 500 pesos at sb nia isulat ko s letter n kusa kong ibnbgay ung perang iyon. tapos aftr nun pinauwi n ako. ngyn pu hnd ko alam kng anu ang mngyyri skn? sasampahan p rin b nla ako ng kaso kht n isinoli ko ung mga goods n un at nkpgbgay ng pera. atty, tulungan nyo po ako. hnd ko alam kng anu mngyyri. nttkot pu ako n makulong. pls help me. thanks

if they let you go, i don't believe the will still pursue a complaint against you. their best opportunity was when they caught you in the act.

this does not mean that they are barred from filing a complaint against you, but from your facts, I do not believe that they will do so.

stop speculating. just get your nbi clearance so you can end your fears. i am with wolverine in saying it is highly unlikely that they filed any case against you.

Ngshoplift po ako 2 years ago sa sm mall, nahuli po ako tpus dinala po ako sa security office nila then may pinapirma sken na anu gagawin nla pg nahuli ulit ako at ung pangako na sa waiver at picture with my name pero d po nila ako pinagbayad nirelease din po nila ako after 2 hours sbi okay na daw po. pinagsisihan ko na po un isang pagkakamali huhuhu.

Natatakot po ako since graduate na ko kukuha na po ako ng clearance sa nbi sa tingin nyo po ba ngfile ng case ang sm against me? im worried po kc ako baka ikulong ako or bka d ako makaalis ng bansa. Hope to hear from you po

just look through the advice we gave in this thread. it is unlikely they filed a case, but better not to speculate and just apply for the clearance.

@chichirat: last year i made the same embarrassing mistake, at the same mall and the exact same thing happened to me, pinapirma,didn't asked me to pay anything and released me with the warning that they would put me to jail if i get caught again. like you pinagsisihan ko nang sobra ito. now come the NBI clearance. i had to get one last month coz of migration purposes. i couldn't bring myself to go to NBI sa sobrang takot. but i had no choice, i went there and i went through the process. na HIT pa ang name ko sa NBI kaya i thought i'm going to jail right away. they asked me to come back after 3 days. u couldn't imagine how stressful those three days were. takot na takot ako na baka pagbalik ko sa NBI makukulong na ako. luckily i got "NO RECORD ON FILE" meaning clean record. i vowed never to be tempted again, coz it could ruin my plans, my life. i was so ashamed of what i did.

it will be reflected if the case was actually filed in court. if you have a pending case, the nbi will give you the info where the case is filed. good luck.

atty help po..nangyri dn po sakin ung gnwa kay arresto meanor.. but the problem is, they have my finger prints,photo,information,waiver and ask me to have voluntary payment for settlement.. which is ok nmn po paguusp nmin and got staight to the point ksi that time myhubby and my kid are waiting for me outside.. nilagay ko s waiver yung hindi ko bnyran ung item,and apologizing.. pero gnto po kasi yung ngyari ngrocery po kami worth 3500 sa sm supermarket. tapos me nkita ako foundation worth 140 since wlang nktngn ntuwa akong itago s bag ko.. tpos nung nbyrn n lht ng item ngpnta kmi s parking lot tapos me sales lady nlumapit skin nanginginig at ngsosory nkelngn ko dw smama sknya at pnkta ko nmn ung bag ko na buong buo..nakit aung item, sabi sakin bayaran nlang daw yung item tapos smama nmn ako s office nila tapos doon, nagusap kami nung LP tapos po kinuha niy aung finger print pnicturan po ako s digicam nila at tningnan id ko nirecord nila.. tapos pinasult ako ng waiver.. and then, akala ko saakin n ung item.. sabi niya.. pede naman dw ako bumili nlang sa itaas.. tapos she was even nice and covered up for my husband hntd p ko s parking..pero natakot ako kase ako lng ata kinuhanan ng finger print at picture na me hinawakang white board n hindi ko nkit akung anu nksula tkse tkot n tkot ako.. nahiihya ako sa sarili ko at sa hubby ko.. and worst my family could find out.. kya tnon g ko lang po atty hindi ba lalabas n meron akong record na shoplifting pag nagapply at binackround check ako? at s mga documents ko?? like nbi? at hndi dn b nila ipinupublic yun?? maraming salamt po in advance,, sna masgot niyo po mga tanong ko..=( sobrang nagsisisi ako kasi this was my first time na gnwa ko to., tpos i even get caught. Question

miss, when did this happen? the fact that they let you go means they will not file a case against you.

the nbi records are updated only when a warrant of arrest is issued. i recommend you put this thing behind you.

Last saturday po eto ngyari.. but im still worried po, bka ipost nila yung picture ko at mkta ng fam ko.. does it mean din po ba na hindi na din ako pedeng magpunta ng mall na yun kahit sinabi ng LP na "PEDE KA NAMAN BUMILI NITO NEXT TIME S ITAAS".. ? thank u po.

Hello AttyLLL,

does mall security have the legal right to take someone's fingerprints?

and if they accept a payment from the person caught, doesn't that somehow settle the whole matter? and they no longer have the right to then file a police report or file a case?

do the stores even have legal right to accept this 'bribe' money? is it not the courts to decide the monetary damages/penalties?

(and just in case you are wondering, no, i haven't shoplifted since i was maybe 5 years old, and i'm not worried about picking up my nbi clearance Smile i just find this interesting, and if whether or not the mall/store security are doing any justice.)

a legal right, no, they do not. i would argue that acceptance of payment can be considered settlement. not sure what you mean by bribe money, but the extra amount can be considered settlement of damages.

in your opinion, do the people who are caught and pay get an official store receipt for their penalty payment? if not it goes into the pocket of the security guards and that's a bribe. or obstrucion of justice?

if a crime is committed, must not it be reported? there must be a law that crimes must be reported is there not? and whether or not 300 pesos of groceries or 140 cosmetics is worth the time and hassle is not the issue.

it gives the wrong message to these shoplifters.

bribe: money or favor given or promised in order to influence the judgment or conduct of a person in a position of trust

would the security let these offenders walk out if they didn't pay the money? then i think its a bribe. more so if the amount is not fixed, and there's no official receipt involved.

for example,(notwithstanding the point about reporting crimes) if the store had a posted policy stating shoplifters would be let go after paying P500, i would not consider that a bribe. but when the security guards just ask how much the caught offender can pay, isn't that a bribe?

if it was a police officer and not a security officer that caught the shoplifter, and then they let the person go after getting paid 500peso and didn't file a report, is that not a bribe?

if the security guard or police accept money so they will not report it, that is a bribe.

if it is the store's policy to allow discretion to make the shoplifter pay for the items, sometimes with premium, then that is a valid compromise. note that theft is included in the list of crimes which may be compromised.

there is a court in pampanga which has to handle all the shoplifting cases of a large mall. the entire day of the court is used up just to hear these cases. most of them will just end up with the accused filing for probation. the judge, pao and prosecutor and the staff hate that they are forced to hear those cases.
