help nman po on this case my husband has been accused of qualified theft ng company nila kse ni review lhat ng originals reciept ng company at nlaman nila n di laht ng BO or bad products n dpat i return sa company ay naibabalik ng kumpleto my husband has only been assigned sa delivery last nov.at di p nya alam ang kalakaran ng lht ng incharge sa del.at meron s kanya nkita n lapse sa 2 resibo..he was forced to make an statement na ginagawa nila ung pangungupit sa company at dhil dto pde dw sya kasuhan ng qualiifed theft..ano po ang pde nmin gwin pra ma retract yung pinirmahn nyang statement pde rin po b yung gwin ebidensya sa knya at icharge lhat ng nwawala sa company sa knya? pls help gusto k lang po malinawan every details regarding sa kaso na ito..maraming salamat po..

if a confession is to be used as evidence in a criminal case, it should pass these 4 requisites:

The four fundamental requisites for the admissibility of a confession are (1) the confession must be voluntary; (2) the confession must be made with the assistance of competent and independent counsel; (3) the confession must be express; and (4) the confession must be in writing.

I assume that your husband did not have an attorney to assist him during the confession. dun pa lang, di na pwede gamitin yung confession niya kung magsampa sila ng kasong kriminal.

what was done to him to make you conclude that he was forced to sign the confession?

wla po syang atty.nung pingawa po sya ng statement..sbi po ng boss nya madmi po silang ng hawak n receipt na ngbbebnta sila ng bad products (BO) ang actual po n reciept n nkita ng mr. ko with sign eh 2 with 500 pesos n amount.. with that amnt eh pde k n po bang kasuhan ng qualified theft nttakot lang po ako bka icharge s knya lhat ng nwawala kse mya case po n ganun yung isa nyang ksama n naipakulong nila at nag bail po ng malaki..sbi ng boss nya umamin n n sya para di lumaki ang kso nya..kaya po gumawa sya ng statement dhil dun sa 2 resibo n may pirma nya. maraming salamat po sa enlightenment re- this case hope masagot pa po ang iba kung inquiry...

naku ganyan ganyan din ang sa akin.. ang daming pananakot kaya.. napilitan din akong magsign ng kung ano2x.. thats why im asking any advice here iun the forum.. sobrang nakakalungkot baon ka na nga alo ka pang binabaon...

The amount of P500 is sufficient for a case of qualified theft.

I suggest that your husband try to continue cooperating with his management but avoiding to issue anything else written. If the amount is only P500, and they have not filed a complaint yet, then hopefully they won't anymore.

thnks for the advice..at this time all of their employees are under investigation meron p din po n ksmahan nya ang nkitaan ng ganun case..pinpablik pa po sya after 2 weeks for further investigation
ano po dpat nmin gawin harapin p po ba sila kse dami n din po ngalit sa asawa ko n mga ksamahan nya ng sya dw po ang nagturo sa ganun nilang gawain.. nttakot n din po ako sa safety ng asawa ko..marami pong slamat

your husband is indeed in a very bad situation. and the answer to your question cannot be based on a legal opinion.

the choice of cooperation with management vs. possible revenge by co-employees depends on the weight of the consequences of each option and the probability that these consequences will occur. only your husband is in a position to decide that.

nahuli po ako kumuha ng product sa company namin worth 720 pesos...pinilit po akong pumirma ng incident report, dun po nkalagay n inamin ko kc un nga po pinilit ako kc akala ko po makakatulong pra maayos..un po pla ginamit nla as evidence pra sa akin...ask ko lng po kng ilang taon ang sentensya ko at anu po ang dapat kng gawin....

nakakaso na po ako ngaun qualified theft po..ano pong advice ang pde nyo n maibi2gay...

second opinion po sana...

hello po,. ask ko lng po kung magkano b bail for qualified theft? is 50, 000 reasonable? uhm, my father is in jail right now, accused of qualified theft, tenants po sila tapos until now e d p rin binibigay title ng kabahagi nila.. part ng lupa ay mga "sasa" yung ginagawang pawid or pambubong, sinasaka yon ng tatay ako, i dont know for what reason kng bakit sya nakasuhan ng qualified theft ng may ari ng lupa. advice please, tnx

I need your advice...Salesman ako dati. I was accused by qualified theft for 53K in sum of the unliquidated 37K inventory and 16K cash na bayad ng isang customer daw. Naka bail ako. Naka present na ang kabilang kampo ng kanilang witness at ako na ang ma present o question sa next hearing sa next month.
Question lang attorney, pagkatapos ng hearing o question sa akin, matatagalan pa ba ito? I mean, how long will it take get the decision from the judge?
...will it take years pa ba? at sana nga...kasi indi ako maka tulog sa pag iisip pag malapit na ang hearing.
...last question, sakaling bayaran ko na lng sila sa demand nila para e urong ang kaso? pwede pa ba iyon kahit naka present na sila ng witness at nka present na rin ako? kasi hirap na hirap na ako. Gusto ko na lng bayaran lahat para matapos na ito.

I already have an attorney. Kasu nga lang indi kami masyado nag uusap at ayu ko namang tanungin sa kanya ang ganyang question baka mag isip sya na wala akong tiwala na mapapanalo namin ang case. Ang problema nga lang hirap na hirap na ako sa pag iisip araw araw na baka ma kulong ako. Kakapanganak pa lang ng misis ko at ayu ko rin mawalan ng tatay ang anak ko kaya gusto ko lang malaman ang reality about this case at para maka desisyon rin ako ng dapat kung gawin. I dont want to just rely on my lawyer, i want to help my lawyer by doing my part as well.

Please help me attorney. I just need your advice and opinion. Thank you AttyLLL.

messenger, unless your lawyer is being negligent, he is still the best person to direct your questions to.

you can validly reach out to pay the civil aspect of the case if they are willing to issue affidavits of desistance before the prosecutor

just would like to ask. A criminal case was filed against my friend for qualified theft, a subpoena was then issued. During the first hearing, the complainant submitted an affidavit of desistance. The case did not pushed through. Will my friend get a bad record when he get his Police or NBI clearance? Thank you
