good day. The uncle of my friend lent to her 200thousand with an interest of 4.5%.
She paid 9thousand every month. For 35months she paid it regularly until her uncle died. Now,her uncle's children and wife demand her payment also. Until now she is still giving money to them that it reaches already to 423thousand in totality (from the very beginning).
Now she is asking help since she wants to stop paying and giving money for the reason that she has given big amount already.
Meron po syang pinirmahan sa notebook ng uncle nya.
Questions po:

1. Pwede ba syang mag stop na sa pagbigay?
2.Pwede bang magsampa ng kaso ang pamilya ng uncle nya sa kanya?
3. Sa mga ibinayad nya, pinapirma nya sa notebook ang cousin nyang kumuha ng pera., can this serve as evidence of her payment?
4. May legal basis din ba ang ganitong "loan shark"?

Good day! My cent of advise is to stop paying and let them file a case. It is true that obligations and contracts entered into should be complied with and the usury loan have been stopped so, any interest agreed upon must be respected but jurisprudence tells us or the rulings of the court says that if the interest is "unconscionable" it must be reduced. In your case, the interest is so high or unconscionable and the judge will lower it or just let you pay the amount loaned or principal without interest anymore.

hi i need advice lang po kasi nagkaroon kami ng over charge sa paypal yung friend ko sa kanya yung card. hiningan nya ko ng collateral sa over charge binigay ko sa kanya yung phone ko ngayun naka receive ako ng Subpoena tungkol don.nakalagay po violation of R.A.8484 hindi ko po alam ang gagawin ko pls help me po.pls

This might help you know what is R.A.8484 but I doubt you committed fraud. Here in US and UK it is common for paypal to contact you this way. We have paypal fraud going on in US and UK. so better track the origin of that letter before getting alarmed they may be trying to victimised you.

Not written! no evidence! No case! Just pay the rest 4K she borrows then ignore the interest. As easy as that! If they don't have proper license to this kind of business and they are giving high interest they should fear you if you file a complain against them. But as you said this is not written so no evidence. You can't file a complain neither.

Hingi lang po sana ng legal advise. Nagpahiram po ako ng pera na may tubo na 1.5%/month.Akala ko po ay babayaran din kaagad pero umabot na po ito ng almost 4 years. Sinabihan po ako ng umutang sa akin (Janet) na nasa Canada ngaun bilang tourist na babayaran din naman daw po ako. Ang asawa niya (Boy) ay nasa Pampanga ngaun pero hindi nakikipag usap man lang sa amin. Sabi nya po eh wala daw siyang cellphone nung pinuntahan siya ni misis sa Pampanga. Pwede po kayang gumawa ako ng affidavit or at least dokumento na papapirmahan ko kay Boy na nagpapatunay na may pagkakautang siya sa akin. At least may habol ako sa kanya if ever takbuhan niya ako. Ask ko po ng advise may umutang po sa akin ng 12,000 pesos at gumawa kami ng kasulatan garantiya ang lupa nila na more or less 1 hectare with coconut trees more or less 50 trees. Ayon sa agreement na pinirmahan namin na kami ang mag harvest ng proceeds ng mga niyog at ibigay nila ng buo ang amount na inutang nila but without any duration ayon sa agreement na notarized pa po. More than 1 year na po nag exist ang agreement gusto ko pong kuhanin ang pera kasi yong location ng lupa ay nasa malayong lugar at inaabutan lang kami ng kaunting halaga ng kita sa niyog. To be fair with them nagkaroon kami ng verbal agreement na 50-50 share kami sa harvest ng niyog kasi sila lang din ang binigyan ko ng authority to manage and cultivate their own land even na nakasangla sa akin. i would just like to seek advice regarding po sa installment appliances. My husband got TV set worth 29k and a sala set worth 26k. That is 12 months to pay. morning po. meron po kaming family friend na foreigner, na very kind enough na ibinili ng tricycle ang 2 pamangkin kong lalaki upang makapaghanapbuhay at makatulong sa kanilang buhay. sa isang kondisyon na huhulugan nila ng 100 pesos a month (which is very lenient and kind enough!). Sa kasamaang palad po, they (my nephews) took it for granted, and they thought it's ok na huwag magbayad! Now, although ang mga papers sa mga nasabing tricycle eh under my sister's name, isa sa mga pamangkin ko ayaw isoli ang papel (he had it last month dahil siya ang nagparehistro). Nagmamatigas siya, ano po ba ang best way para makuha namin ang papers? Our family friend is now adamant to SELL the tricycles, dahil nagalit na po! Nahihiya na po kami, syempre! This is idiotic! She cannot do that if you are willing to pay it directly to her account. 
You should know your consumers right if she try to be awkward try to seek advice with Philippine Fair Debt Collection Practices Act if they get involve that 6 months can turn into longer payment. As a consumer they cannot stress you in debt.

good day!i hope you can help me with my problem.i borrowed P20,000.00 from my siister's friend.She lend me the said amount but I have to pay a 20% interest monthly & when I failed to do so I should add up a 200pesos daily penalty.It was last January that I borrowed the money, she let me sign with a paper under a certain microfinance that I was a co-borrower for a certain person I dont even know.I did because I badly needed the money, I already paid P22,000.00 but she still demands fro P32,000.00 since the said money was returned 6mos after. I only ask her to lower the interest since I was recently had an operation & cant afford to pay her that huge amount.She said she would file a case against me in the brgy, but I dont see the brgy as a proper venue because they only humiliate the person & really I dont find any proper settlement except for people will atlk about you afterwards.Is there any way that I have the right not to attend the invitation & can I file against the said person since she harrasses me a lot.I hope you could help me.Many thanks.GBU
