dear attorney,

natanggap ko po last week yung decision ng NLRC regarding po sa finile kong complaint sa aking previous employer. ang claim ko po ay for unpaid salaries, holidays and 13th month pay. during the negotiation di po nagkasundo dahil sa ayaw po ng employer ko mgbayad dahil sa may training bond daw po ako.

since di po ko nakapagfile ng position papers on time, nwaive po yung claim ko for unpaid salaries and holidays kasi wala pong basis pero ang eto po ang final decision ng arbiter:

"as complainant failed to file his position paper, there is no basis for this office to determine the period for which he claims his salaries were not paid. neither is there a basis to conclude which holidays he rendered work. the 13th month pay can, however, be adequately determined considering that complainant work for three months. thus he is entitled to PXXXX.XX x 3/12 or the amount of PXXXX.XX

this office cannot, however, offset this with respondent's claim for training cost for failure to present a copy of their agreement. hence, lacks jurisdiction over the nature of the said claim."


"wherefore, in view of the foregoing, RESPONDENT is ordered to pay complainant the amount of PXXXXX representing his proportional 13th month pay."


tanong ko lang po kung posible bang hindi ibigay ng former employer ko yung 13th month pay kahit my decision na?

ano pong dapat kung gawin kapag hindi nila binigay yung 13th month pay ko?

pwede pa ba nila ipagpilitan yung training cost na sinisingil nila sa akin?

kahapon po tumawag ako sa labor tapos tinanong ko po kubg ngfile yung kabila ng appeal, ang sabi po nila gagawan pa daw po nila ng certificate of finality. after po ba nun makukuha ko na yung 13th month pay ko? sa NLRC din po pa ba ngmimeeting or kapag meron na nun pwede na ko dumirekta sa dati kong employer?

malamang mga 2months na naman bago dumating yun kasi po yung decision dec. 29 ang date pero last week lng namin nreceive.

ah, kung may certificate of finality, dahil hindi na appeal, maaari na ma-execute ang desisyon, mayroon nang forms doon sa NLRC para sa motion for issuance of writ of execution, dapat NLRC ang mag-eexecute nun, sila pupunta o magpapadala nang desisyon sa employer mo.

ngpadala din po sila ng copy ng decision sa employer ko at kakareceive lang daw nila ng return card tapos gagawan na daw nila ng certificate of finality at dahil masungit sya di ko po natanong kung ippadala ba nila yun by mail or kung papano ng susunod na mangyayari at kung paano ko din po makukuha yung 13th month pay ko.

ano po ba yung tamang proseso? salamat po.
