Hi Atty. I have some questions po. A friend of mine was caught last Tuesday, Jan. 17 after he held up an online casino in Ortigas. I don't know if you have heard of that over the news in GMA 7, i think it's still in their website, He was charged Robbery and illegal possesion of Firearm.

My questions are:
1. Bail is temporary release from jail right?

2. He need to attend court hearings? Hanggang ilan beses po ang hearing?
3. If found guilty, how long is jail time?
4. Would it be possible that he'll get out of it eventhough he was caught? Meaning hindi po siya makasuhan?
5. Sa tingin niyo po sa sitwasyon niya, makukulong po siya?
6. From 1 to 10 Atty, 10 is the highest, ilan po ang chances niya na hindi po siya makulong at ilan po ang chances na pwede siya makulong?
7. If jailed, saan po siya kaya dadalhin?
8. Ano po ang pwedeng ilaban para hindi siya makulong?

Atty, we need your honest opinion po ha. Be frank if you have to.

Atty, we are so worried about him. He is one of our close friend. In fact he is like a brother to me already. If ever he goes to jail, meron siyang maiiwan na 2 maliliit na anak at asawa. I know he should have thought about it before commiting such crime. Never in our wildest dreams that he would do such thing. Please enlighten us Atty para ma-prepare lahat kami sa ano man pwedeng manyari sa kanya. If in case he needs a lawyer, do you handle such cases po? Can you give us an idea how much would it cost for a lawyer? Alam ko po pag may court appearance may bayad na po yun di ba?

i think bail will be about 100k. if he cannot produce bail, he will be detained at the city jail during the duration of the trial. if he escapes while out on bail, the 100k will be forfeited and a new warrant will be issued.

the prosecution may present the cashier, guard and police to establish his guilt. the illegal fire arms should not be a separate case but it will aggravate the penalty to the maximum allowed 8-10 years, if i'm not wrong.

i recommend he discusses plea bargaining with his lawyer.

Hi atty. Thank you for the reply. They were able to post bail. Mura nga yun hiningi, I think around 23K lang. He is already out of the police detention place. First hearing is on the 14th pero wala pa ata silang lawyer. They were recommending PAO but i don;t know kung nakakausap na sila.

Atty. so kung sakali po ang pag uusapan nalang is pano mapapababa ang sentence, tama po ba since may evidence or guilty na yun friend ko? Pwede po ba maareglo yun kaso para hindi na siya makulong? Kung sakali po maareglo, may criminal record pa rin po siya?

Atty, good eve... The Provincial Intelligence Police served a search warrant in my house on Feb 14, 2012. I was out of the house and in another place. My wife received and signed the SW then together with some brgy officers did the searching. Although, the SW specified the ff firearms such as 1)baby armalite 2) cal 45 3)9mm pistol 4)9mm machine pistol 5)assorted ammunitions and magazines, what they have found is only an unlicensed 9mm pistol placed at the dresser. My wife called me up and I immediately went home and talked to the police officers. I admitted owning the unlicensed 9mm pistol but I have never taken it outside of my residence. Am I liable of illegal possession of firearms? Thank you Sir.
