OFW wanted to file annualment of marriage

Gandang araw Atty,
Kasal po ako sa Catholic church last 1991. Ilang taon na din po ako ng tiis at ng antay ng pagbabago but still he is into drugs. Ng sha-shabu po ang husband ko. I tried na po na maka iwas siya dito sa bisyo niya at kinuha ko po siya na kasama ko mg work dito sa middle east. Pero hindi po siya maka tagal at umuwi din pong Pinas. 3 po ang anak namin 20, 15 at 6.
Ang tanong ko po pwede ko ba siya hiwalayan? Hiwalayan na legal po at wala na akong responsibility sa kanya bilang wife? Yearly lang po ako pwede maka uwi sa Pinas. Papaano po ba ang gagawin ko?

if just to have separate finances and/or live separately, you can file a complaint for legal separation or separation of property, but you will remain his wife.

if for annulment, it will depend if you can prove a ground for annulment.

last year po kami ngfile dito sa Israel Court at Nito pong February 12 2012,pinadalhan po kmi ng court dito na Annualment Case is Close/Approval by a Israel Court..

Question ko lang po Attrty: Ano po ang dapat kong gawin para Ma-Recognize diyan sa Pilipinas ang annualment ko at desisyon ng Israel Court dito,
at mapalitan na din po ang Status ko bilang Separate/annnnual.

your real first step is to retain a lawyer. the process is to file a combined petition under rule 108 and recognition of foreign judgment.

Hi po,Im Shey. i have the same case filed for 2yrs already still on going. "Declaration of Nullity of Marriage since my age is 17 only at the time a pixer in Manila City hall offered a marriage cert. without appearance and parental concent. My ex, at age 38, took the advantage of it. Now it has record on NSO with my fake birth year.

Currently im a DH(OFW) single mother, who at first advice that i can be represented by my atty. But now, the judge want my presence, but he always re-schedule the hearing. It's not easy for me go back spend money for ticket for something that is not definite. But if i didn't attend the case will be dismiss.

What are the options i can do:
Withdraw my petition?
Can transfer my case to other branch?
Can i re - file it in other branch? or shall i go back every hearing and take my chances?
Normally how long should this case take and how many hearings?

He would like to file for an annulment case wherein he doesn't want me to get involve nor sign into anything. Worried lng po ako, kc we have a child which is also under his name, and I want na mgkarun ng sustento ung anak ko even after annulment. what are the steps po pra malaman ko kng nkpg file na sila ng annulment case. myhope, what is important is that there is a ground for annulment. look up grounds in the forum.

shey, you really should discuss this with your attorney. compliance is better than asking for exception.
