refund of house rental deposit

hi sir! would like to ask this.. we paid for 2 mos. deposit and 1 month advance for house rental. we consumed the 1 month deposit coz we need to move because of our job calls.we just stayed 5 days extra from the date we're due using the advance.Technically we still have the 2 mos. deposit--just less the 5 days of extra stay. coz the rent for a month is 3,800. We stayed there from Oct 15- Nov 20, 2011. Are we still entitled to get the 2 mos deposit less 5 days of stay? coz the lessor is insisting that 5 days of extra stay is equal to a month consumption so she's just refunding 1 month deposit and less from it is the remaining electric bill? is that fair? hope for ur immediate response. What shall we do if we have the right to get the 2 mos. deposit? shall we invite them for barangay hearing? thanks a lot. waiting for immediate response pls.

did you have a written contract? what does it say about termination. in most cases, if you don't finish the term, the deposit is forfeited
