I have a estafa case filed against me in mindanao rtc. Another case was filed again here in Manila. My question is, can we file motion to dismiss due to non forum shopping since the case has the same complainant ( company ) represented by two different individuals, same witness ( 1 client) but different amount , first case is 800th and the 2nd case is 400th. I was not given due process by my former employer, they have filed a case against me, when I was still employed and while the investigation is still on going.
