Hi atty,

question lang po. In what cases would insubordination be a just cause for termination? Kailangan po ba strictly work related or does it extend to non work related stuffs?

Can an employer terminate your employment because you simply disobeyed a direct order or a rule implemented by your immediate supervisor na hindi naman work related?

it's regarding dress code. The company's dress code policy allows business casual for non-management personnel from Mondays to Thursdays, which means slacks and golf shirt/poloshirt would be acceptable. One arrogant supervisor wanted to implement a business/corporate attire (coat and tie) on a certain day of the week. Anybody who doesn't comply would have to pay a fine, which will be used for a team activity or for food on the team's christmas party. There was no consensus from the team prior to the release of the email. The supervisor planned it and finalized it.

Can a supervisor overrule the company policy on dress code for solicitation of funds that will be used for non work related activity.

And isn't solicitation not sanctioned by the HR being frowned upon, if not downright wrong?
Does the supervisor have the right to terminate an employee for failure to comply or insubordination on such non work related matter such as this?

moderator

i recommend the team reports the activities of the supervisor to the immediate superior or to HR. any disciplinary action he imposes should not be warranted.
