Good day po! Ask ko lang po kung bawal po ba ang mag record? Ang sabe po kasi ng boss namin wire tapping daw po ang ginawa ko at pwede po ako matanggal sa trabaho. Ito po ang scenario. Isa po akung permit coordinator sa Okada Manila. MAy ginawa po ako na permit na kinakailangan pala ng pirma ng AMCON. Pero ung company po namin wala po sinabi na need papirmahan un inaanounce po nila sa meeting.
Nung mahuli na po ng Amcon ung permit at need po pala papirmahan sakanila itinanggi po ako ng company namin sinabi po sa Amcon personnel na sinungaling ako.kaya inerecord ku po ang pag tanggi nila at pag amin nila nung kinausap ko po sila na totoo namn wala silang memo na binaba na need na pumirma ng Amcon.

Nung nalaman po nila na nairecord ko po ung pag uusap nila ng AMCON na itinanggi nila ako at pag amin nila sa akin ng mali nila. Kinakasuhan nila ako ng Wire Tapping Insubordination daw po iyon at pwede ako materminate.

Tanung ko lang po pwede po ba ko materminate kung wala naman po silang Memo na binaba na bawal irecord ung pinag usapan. mateterminate po ba ako nun.

Sa ngayun po ibinaba nila ako sa posisyun ndi na nila ako pinag pepermit hintayin ko nalang daw po ung papel na terminate na ako.

Sad to say, it is indeed a violation of the Anti-Wiretapping Law (which is a criminal offense, mind you). If they will terminate you, though, it would not be on the ground of insubordination, but on gross misconduct. There is no need for them to issue a memo that recording is prohibited, because everyone is expected to obey the law. Be that as it may, your company still has to observe your right to due process before they impose disciplinary sanctions upon you such as demotion or termination. https://www.alburovillanueva.com/dismissal-termination-employment They should still comply with the two-notice rule in terminating an employee, otherwise your dismissal would be illegal.
