13th month pro rated

Hi,

Ask ko lang po sir kung ano po dapat naming gawin dahil ang company namin nag memo po kanina 11/12/2011 re sa 13th month namin. Nagsend ng criteria sa mga tatanggap ng 13th month. Ang makakakuha lang daw po ng buo ay yung nahire ng from Nov 1,2010 to Oct.31,2011. Nahire po kami ng nov.30 ng 2010. so di daw kami eligible sa full amount ng 13th month na ibibgay nila sa Nov.25. Tama po ba yun?Parang di namn righteous yun.Panu po ba dinedetermine ang 13th month. Nkalagay pa sa memo na kung nahire ka ng Oct.2 ng current year wala ka ding makukuha maski prorated. Please help us po and advise me what to do. God bless

i suggest you make a complaint to dole and give a copy of the memo.

it is not right for the company to decide what period will be considered. the law states it is for the calendar year.

13th month pay is being earned from day 1 of work so even a newly hired employee is entitled to a 13th month pay computed as earnings in the calendar year divided by 12.

tama..13th month is prorated if di nacomplete yung one calendar year, meaning you have at least 1/12 up to 12/12 in one calendar year..
