Good afternoon po, Atty.

Biglaan po kasing hininto yung operations ng department namin. Tapos ngayon po, tinerminate kami dahil sa unproductivity at delay daw ng project.

Nung sinuspend kami, walang previous memo. Tapos ako po na manager, binigyan ng isa pang memo at ginawan ng kaso na grounds for dismissal. Yung mga tao ko po, memo agad for termination. Yung isa, naunang ni-retrench.

Plano po naming ilaban to. Sinabihan ko sila na wag muna magpunta ng office para pirmahan yung termination memo at quit claim. Ako po, di pa tinatawagan ng HR.

Tama po ba na Constructive Dismissal ang case nito or Illegal Dismissal na kahit di pa namin napipirmahan yung memo?

Tapos 44 hour work week po kase kami. Tama bang hindi overtime yung four hours extra? Ang alam ko po, walang overtime ang managers so sa kin po walang kaso. Pero dun po ba sa mga tao may kaso sila?

moderator

a manager is not entitled to ot pay.

what you should file is actual illegal dismissal, not constructive. your case should be separate because you have a different reason for being terminated.

Actually, same reason din po. Dinagdagan lang nila yung sa kin. At ako lang ang tinira nila nang ganun. Yung mga tao ko po di na nila hinanapan. Separate na case pa rin po ba dapat yun?

Also, yung tao ko po na nakapirma na dun sa retrenchment, pwede pa rin ba sya mag file?

yes, those who were retrenched can file a case. so can you, but as i said you were fired for cause, not retrenchment.

Oo nga po. Pero di po ba ang kaso pa rin nila Illegal Dismissal kase tinigil po nila yung operations ng walang pasabi? After lang nun po nila ko kinasuhan eh. Nung narealize nila na alam kong pwede ako magdemanda.
