hi,im a filipino citizen living in japan and was wondering if someone could give me an advice on how to get Certificate of Finality of Decision and Court Order/Decision.

kinasal ako noong 2002 sa manila. we are both filipino. but unopportunately wala pang 1yr after marriage di na naging maganda pagsasama namin.we decided do live seperately. my husband file an annulment of our marriage.na-annulled yung kasal namin sa pinas last 2008.since dito na me naninirahan sa japan, wala ako nung naganap yung whole process ng annulment sa court. nakareceive na lang ako ng decision of the court na annulled na yung marriage ko. This year lang ako nagkaroon ng time na mai-reprot yung annulment ng marriage namin sa consulate dito sa japan. kaya lang hindi pala sapat yung Court Final Decision lang. Hinahanap nila yung Certificate of Finality of Decision and Court Order/Decision.

I don't know where to get it and what department or agency in the philippines issue that certificate. Hope someone in this forum have an idea. Thank You very much!

It depends kung nasaang court level na cya. I assumed na ung hawak mong court decision is from an RTC level. You just have to call the court that issued the order and ask if the decision was appealed, in this case di pa final ang decision. If the decision of the court was not appealed then ask if nag lapse naba ang time to appeal and then ask for the certification of finality of judgment.

have you requested a copy of your marriage contract? there is no annotation that the marriage was annulled? if so, do go to the court and find out what happened. it may have been appealed.

again you should discuss this with your lawyer. if the OSG appeals the decision then it is not yet final.
