Hi attorney,

If the person has filed a force resignation due to dismissal. What are the benefits that they can have based on the labor code. He is 10 years in service in private company. Thanks!

if he filed a resignation letter, he is not entitled to any separation pay. he will have to file a case at nlrc to claim anything.

If the preventive suspension last for 30 days. And after the 30 days the employer have given to the options to resign or be dismissed. Is this a form of constructive dismissal? Is constructive dismissal legal?
